Court Fines Man Ksh24 Million or 10 Years in Jail for Bhang Trafficking

The Director of Public Prosecutions (DPP) has secured the conviction of Vincent Odhiambo for trafficking 266.2 kilogrammes of Cannabis sativa, commonly known as bhang.

In a notice dated September 26, the DPP said Odhiambo was convicted after the prosecution presented evidence linking him to the trafficking of the narcotic drug in Elgeyo Marakwet County.

“The Director of Public Prosecutions (DPP) has secured a conviction against a man found guilty of trafficking in narcotic drugs,” read part of the statement.

DPP Secures Conviction Against Bhang Trafficker

Following his conviction, he was sentenced to pay a Ksh24 million fine or serve 10 years in prison in default.

According to the prosecution, Odhiambo was found on January 18, 2026, along the Kapchorwa-Torongo Murram Road in Kamwosor Location, Keiyo South Sub-County, Elgeyo Marakwet County.

The prosecution told the court that Odhiambo, alongside others, was trafficking 266.2 kilogrammes of Cannabis sativa in a Toyota Fielder motor vehicle.

Odhiambo was charged under Section 4(a)(ii) of the Narcotic Drugs and Psychotropic Substances (Control) Amendment Act, 2022.

The prosecution was led by Principal Prosecution Counsel Felix Namasake, who presented six witnesses in support of the case.

After considering the evidence, the court found Odhiambo guilty and subsequently convicted him of the offence.

“Prosecution, led by Principal Prosecution Counsel Felix Namasake, told court that on 18th January 2026, along Kapchorwa-Torongo Murram Road in Kamwosor Location, Keiyo South Sub-County, Elgeyo Marakwet County, Odhiambo, jointly with others, was found trafficking 266.2 kilogrammes of Cannabis Sativa (bhang) valued at Ksh. 7,986,000, being conveyed in a Toyota Fielder motor vehicle,” DPP stated.

Court Considers Quantity of Bhang Before Sentencing

In determining the sentence, the court considered the quantity of Cannabis sativa involved in the offence as an aggravating circumstance.

The court noted that the case involved the transportation of a substantial quantity of 266.2 kilogrammes of the narcotic drug.

After weighing the mitigation against the aggravating circumstances, the court determined that Odhiambo deserved a deterrent sentence.

The court also noted its obligation to protect the public from the effects of offences involving narcotic drugs.

Odhiambo will therefore be required to pay the Ksh24 million fine or serve 10 years’ imprisonment in default.

“Having weighed the mitigation against the aggravating circumstances, the court found that the accused deserved a deterrent sentence and noted the court’s obligation to protect the public from the effects of such offences,” DPP noted.
