DPP Approves Murder Charge Against Fifth Suspect in Dr Victoria Mutiso Case

The Director of Public Prosecutions (DPP) has approved a murder charge against Kimutai Maritim in the ongoing investigation into the killing of Dr Victoria Nthunya Mutiso, bringing the number of suspects set to face murder charges in the case to five.

In a statement dated September 23 2026, the DPP said Maritim will be charged alongside Rose Mbithe, her daughter Angela Mulwa, her son Chris Mulwa, and Police Constable Elijah Kibelion Kimoi.

The five suspects are expected to appear before the High Court on September 29, 2026, for plea-taking, in line with directions issued by Justice Alexander Muteti.

According to the prosecution, Maritim was arrested on August 22, 2026, after allegedly attempting to visit suspects being held at Pangani Police Station.

Arrest Of Suspect

Investigators told the court that he was intercepted while reportedly trying to deliver a loaf of bread and a packet of milk to the detainees.

Additionally, during earlier court proceedings, investigators alleged that Maritim was involved in planning the offence and could help authorities trace other suspects who remain at large.

Those claims form part of the ongoing investigations, and the allegations will be determined through the court process.

In addition, the latest development comes as prosecutors continue pursuing other suspects linked to the murder investigation, including three individuals who were arrested in Uganda and returned to Kenya.

Court Hearing

Police Constable Collins Bett Kilangat, Pius Muiruri Mbugua and Samuel Karanja Gathoni are expected back in court on October 1, 2026, after a court granted investigators 30 days to complete inquiries into their alleged involvement.

The three were arrested on August 29, 2026, at Kyanja Heights Flats in Nakawa, Kampala, before being handed over to Kenyan authorities.

Further, the prosecution has indicated that investigations remain active as detectives continue to pursue additional suspects who are believed to have connections to the case.

The State’s prosecution team is being led by Counsel Jalson Makori and Pauline Muthuri as the case proceeds through the High Court.
