IEBC Issues New By-Election Rules

The Independent Electoral and Boundaries Commission (IEBC) has issued fresh directives on the management of disputes arising from nominations ahead of the November 27, 2025, by-elections.

In a notice published in the Kenya Gazette on October 9, 2025, the IEBC announced that all nomination-related disputes must be determined within ten days of lodging the complaint with the Commission and, in any event, no later than October 21, 2025.

“The Commission makes the following directives relating to the 27th November, 2025, By-Elections,” read the Gazette Notice signed by IEBC Chairperson Erastus E. Thekon, in exercise of powers conferred by Articles 88(4) of the Constitution of Kenya and Regulation 9(1) and (2) of the Elections (General) Regulations, 2012.

Disputes to Be Heard at Designated Venues

According to the notice, disputes “shall be heard and determined at a venue specified by the Commission.”

The IEBC emphasized the importance of timely and transparent handling of disputes to ensure fairness in the electoral process.

The Commission further noted that the Rules of Procedure on Settlement of Disputes are publicly accessible through the IEBC’s website at www.iebc.or.ke.

These rules, it stated, are designed to guide both complainants and respondents in navigating the dispute resolution process efficiently.

Complaints to Be Filed Physically or via Email

Filing of nomination disputes will be done either physically at Anniversary Towers or via the Commission’s emails—info@iebc.or.ke or pple@iebc.or.ke.

This hybrid filing method, the Commission said, is intended to accommodate complainants from various regions and improve accessibility.

Additionally, the IEBC said that complainants will be notified of their hearing schedules via email or telephone calls.

Previous Guidelines Revoked

In the same notice, the IEBC revoked previous nomination dispute directives published in earlier gazette issues—No. 11160 (Vol. CXXVII–No. 169) and No. 11163 (Vol. CXXVII–No. 170)—released on August 8 and 11, 2025, respectively.

The Commission reiterated its commitment to transparency and fairness, emphasizing that the outlined procedures would promote “efficient, timely, and impartial resolution of all disputes relating to the forthcoming by-elections.”
