The High Court sitting in Kibera has ordered a fresh mental evaluation of a patient accused of killing another patient at the Kenyatta National Hospital (KNH).
Lady Justice Diana Kavedza on Thursday instructed that a psychiatrist from KNH be provided access to the Nairobi Remand Prison to do a fresh evaluation of the accused, identified as Kennedy Kalombotole.
Kalombotole who had been admitted to KNH since December 1, 2024, allegedly murdered a fellow patient, Edward Maingi Ndegwa, who had been admitted to Ward 7B, Group C (Male)on July 11, 2025.
Court to Decide on Formal Murder Charge
The court also directed the prison authorities to ensure the accused continues to receive his diabetic medication while in custody.
Justice Kavedza indicated that the final test of the second mental examination will also establish whether the accused is fit to stand trial.
She set the case for mention on November 13, 2025, when the court will determine whether the suspect will be formally charged with murder.

Speaking through the court, the Office of the Director of Public Prosecutions (ODPP) highlighted that the new mental assessment was needed to promote justice and allow fairness in the process.
“The assessment will help establish the accused’s mental fitness before trial,” the ODPP said in a statement presented to the court by Senior Assistant Director Public Prosecutions, Gikui Gichui.
“This process safeguards both the rights of the accused and the integrity of the Judicial System.”

The ODPP reaffirmed that it is committed to be fair and transparent in prosecuting the offender and stated that it will still work closely with the medical professionals and defense lawyers to make sure that due process is respected.
After the report has been filed, the court will make further instructions regarding the course of action to proceed with the murder case.
