A voter has moved to court seeking the suspension of all the ongoing preparations made by the Independent Electoral and Boundaries Commission (IEBC) for the 2027 General Elections, citing constitutional and governance concerns
The petitioner, Bernard Mwanzia, in a desperate petition to the High Court, seeks that the issue be certified as an urgent one and conservation orders be granted to prevent IEBC from proceeding with any preparatory activities.
According to Mwanzia, Kenya has severe constitutional weaknesses in its current system of electoral and governance, which may potentially compromise the legitimacy of the forthcoming general elections.
He warns that unless the court intervenes, the IEBC could continue to commit vast public resources to processes that will be declared unconstitutional or invalid in the future.

“Pending the hearing and final determination of the petition, the petitioner prays for an order restraining the Commission, its agents, servants, or assigns from undertaking or spending public resources on any preparations for the 2027 polls,” the application reads in part.
Petitioner Cites Governance and Legality Issues
The case, according to Mwanzia, raises “serious constitutional questions” that go to the heart of the country’s electoral integrity and governance structures.

He, however, maintains that the balance of convenience is to stop all the preparations pending settlement of the issue in order to preserve the sovereignty of the people under Article 1 of the Constitution.
If granted, the orders would temporarily freeze the current planning, logistical, and policy planning of the 2027 General Elections by the IEBC until the High Court delivers its verdict.
