Stepfather Jailed Over Sexual Abuse of Stepdaughter

The Office of the Director of Public Prosecutions (ODPP) in Kwale County has secured a jail term of 30 years for a middle aged man.

Mangisi Chaka was found guilty for sexually abusing his 12-year old stepdaughter.

The incident happened in Kayawaa village, Waa location, Matuga Sub-county, Kwale County, between April 2021 and November 2022.

How the Magistrate Ruled on the Case

Resident Magistrate Ruth Ogolla in her ruling she stated that Mangisi violated the sexual offence act.

“In her ruling, Resident Magistrate Hon. Ruth Ogolla found Mangisi Chaka Mangisi guilty of defilement contrary to Section 8(1) as read with Section 8(2) of the Sexual Offences Act, 2006,” ODPP said.

He was also convicted of committing an indecent act on a child contrary to Section 11(1) of the same Act.

According to Magistrate, the five prosecution side witnesses produced hard evidence warranting conviction and sentencing.

Assistant Director of Public Prosecution Collins Orwa and Prosecution Counsel Mahdy Twalib represented the prosecution in the case.

During court hearing, suspect had been abusing the minor repeatedly while she was under his care.

How Suspect Was Tracked Down

On January 4, 2023, the matter was brought to daylight after victim narrating the incident to her guardian.

Minor was taken to Kwale Sub-county by police officers for medical examination and P3 form was filled as part of evidence.

“Following the report, police were alerted, and the victim was taken to Kwale Sub-county Hospital for medical examination, with a P3 form completed as part of the evidence,” ODPP stated.

Police, Minor and her guardian visited Lungalunga, Mwamose Village on January 13, 2023 to record statements from individuals linked to the case

DPP also said, “Witnesses corroborated the victim’s account during the interviews.”

On January 22, 2023, suspect was arrested and subsequently tried in court.

Additionally, DPP had warned all sexual offendors against children that they will face the rule of law harshly.
