Supreme Court Lifts Two-Year Ban on Senior Counsel Ahmednasir

The Supreme Court has lifted two year ban on veteran lawyer Senior Counsel Ahmednasir Abdullahi.

In a ruling delivered on January 23, 2026, the court said it was persuaded that sufficient time had elapsed for Ahmednasir to reflect on his conduct and recalibrate his relationship with the judiciary.

The ruling was delivered by Chief Justice Martha Koome and Deputy Chief Justice Philomena Mwilu, alongside Justices Smokin Wanjala, Njoki Ndung’u, Isaac Lenaola, and William Ouko.

The decision followed an oral application made on January 20, 2026, by Senior Counsels Paul Muite and Fred Ngatia on behalf of Nguruman Limited.

They asked the court to lift a 2024 order that barred Ahmednasir Abdullahi, his law firm staff, and anyone acting on his instructions from appearing before the Supreme Court.

“In this regard, we acknowledge the fact that, given the grave nature of the matters that gave rise to the issuance of the Order in question, also noting that a period of two years has lapsed, we are persuaded that Mr. Ahmednasir Abdullahi, SC, has had an opportunity to introspect and determine his relationship with this Court going forward. Indeed, the sanction we issued against Mr. Ahmednasir Abdullahi, SC, was dictated by the need to protect the authority and dignity of the Court,” said the Court.

The application sought the vacation of a suo motu order issued by the Supreme Court on January 23, 2024, which barred Ahmednasir, his law firm employees, or anyone holding his brief from appearing before the court. The earlier order was issued in separate proceedings after the court cited the need to protect its authority and dignity.

Ahmednasir’s Lawyers Provide Assurances That He Will Uphold Decorum

In their application, the Senior Counsels provided assurances that the veteran lawyer would uphold the decorum and dignity of the court moving forward.

The court acknowledged these assurances, noting that the sanction had served its purpose and that there was no reason to doubt the undertakings presented on his behalf.

However, the court clarified that while Ahmednasir is now permitted to appear and practice before the Supreme Court, the 2024 order could not be formally vacated in the present case since it was issued in separate proceedings that had already been concluded.

Lawyer Ahmednasir Abdullahi was banned from appearing before the Supreme Court following a court ruling in 2024, which emphasised the need to protect the authority and dignity of the judiciary. He has been outspoken about issues of corruption within the judiciary, alleging that some judges accept bribes to make rulings in a particular direction.
