The Katiba Institute has requested the Nairobi City County government to provide full disclosure regarding a reported “partnership” with the national government aimed at managing key city functions.
In a letter dated February 16, 2026, and received by the Office of the County Secretary on February 17, 2026, Katiba Institute’s Executive Director, Nora Mbagathi, sought clarity on the nature and legal basis of this collaboration.
“We have written to the Nairobi City County Secretary, under Article 35 of the Constitution and the Access to Information Act, to request full disclosure on the reported “partnership” between the National Government and Nairobi City County in the performance of county functions. Katiba Institute is seeking clarity on its legal basis, scope, financing, agreements, and County Assembly involvement,” Nora Mbagathi said.
The move follows Governor Johnson Sakaja’s State of the County Address on February 11, 2026, in which he stated that collaboration with the national government is inevitable.
According to the Katiba Institute, the alleged partnerships include the performance of specific county functions such as garbage collection, road infrastructure, sewerage and waste management, water distribution, and street lighting.

In the letter to the county government, Katiba Institute is demanding confirmation of whether this partnership exists and is asking for specific documentation, including draft agreements and correspondence between the two levels of government.
“A confirmation of the status of the partnership, including when it commenced (if it has) or when it is proposed to commence (if it hasn’t), as well as the legal or other basis that evidences the partnership, if any,” Katiba Institute demanded.

It adds, “Particulars of the nature and scope of the partnership, including the specific functions the partnership is intended to cover and a schedule indicating the assignment of responsibilities between the two levels.”
The institute has also requested information on the financing arrangements for these functions and the extent to which the Nairobi County Assembly has been involved in the process.
It further emphasized that if any information is withheld, the county must provide a clear legal explanation for the non-disclosure.
“Should you believe that the information requested may fall under an exception to the presumption of disclosure, please provide edited documents with an explanation as to why any redacted material was exempt. Should you believe that entire documents are exempt from disclosure, please identify the document and explain the basis for non-disclosure,” Katiba Institute stated.
