DPP Opposes Release of Kenyan Man Wanted in U.S

The Office of the Director of Public Prosecutions (DPP) has opposed the release on bail of a 74-year-old Kenyan man who is wanted in the United States of America to face serious criminal charges. The prosecution argued that releasing the suspect before the conclusion of extradition proceedings could jeopardize the case and increase the risk of him evading justice.

In a statement, DPP said rhe suspect, identified as Godfrey Mbogori, is wanted by authorities in the United States following an arrest warrant issued by the U.S. District Court for the Eastern District of Virginia on November 15, 2023.

The warrant seeks his arrest to allow him to stand trial over allegations linked to cybercrime and fraud-related offences under United States law.

According to court documents, Mbogori faces charges including conspiracy to commit computer intrusions, conspiracy to commit wire fraud, and aggravated identity theft, as well as aiding and abetting.

These offences violate several provisions under Title 18 of the United States Code.

Authorities told the court that Mbogori was arrested on February 19, 2026, in Meru by officers attached to the Anti-Terrorism Police Unit (ATPU) and the Joint Anti-Terrorism Task Force.

His arrest followed the circulation of an INTERPOL Red Notice, which alerts law enforcement agencies globally that a suspect is wanted for prosecution or to serve a sentence.

The Office of the Director of Public Prosecutions also received a formal extradition request from the United States on February 26, 2026, seeking to have Mbogori sent to face trial.

DPP Opposes Bail

During the court proceedings, the prosecution team strongly opposed Mbogori’s release on bail while the extradition matter is ongoing.

The team, led by Senior Deputy Director of Public Prosecutions Vincent Monda, alongside Assistant Director of Public Prosecutions Duncan Ondimu, Principal Prosecution Counsel Victor Owiti, Magdalene Nduati, and Prosecution Counsel Fatma Shaban, argued that Kenya has international obligations to cooperate in fighting transnational crime.

“Granting bail in circumstances where a suspect is subject to an active international warrant may undermine the integrity of extradition proceedings and Kenya’s international obligations.” Vincent Monda stated to the court.

The prosecution also highlighted the seriousness of the offences and the high risk of absconding as key reasons why bail should be denied.

Extradition Proceedings Ongoing

The DPP emphasized that allowing Mbogori to go free could compromise the extradition process, making it difficult for authorities to send him to the United States if the court eventually approves the request.

The case remains before the court as extradition proceedings continue, with a determination expected in the coming weeks.
