Kisumu Governor Nyong’o Breaks Silence on Raphael Tuju Loan Dispute

Anyang’ Nyong’o has raised serious concerns over how authorities handled the loan dispute involving former Cabinet Secretary Raphael Tuju, warning that the actions taken could undermine the rule of law and public trust in state institutions.

In a statement released on March 15, 2026, Nyong’o said the handling of Tuju’s commercial dispute raises “profound concerns” about how institutions mandated to uphold justice are operating.

“The recent handling of Hon. Raphael Tuju’s loan dispute and commercial affairs raises profound concerns about the conduct of institutions entrusted with upholding the rule of law in Kenya,” Nyong’o said.

The governor questioned the deployment of uniformed police officers in what he described as a purely civil matter, saying such actions risk eroding confidence in public institutions.

Nyong’o emphasized that debt recovery and commercial disputes should follow established legal procedures rather than coercive state action.

“The use of uniformed police officers, whose primary duty is to maintain law and order, to facilitate actions that bypass established legal processes is deeply problematic,” he stated.

He added that civil disputes require transparency and lawful procedures, not forceful operations.

“Debt recovery and commercial disputes are clearly matters of civil law, requiring transparent and lawful procedures. Resorting to nocturnal operations and coercive displays of state power in civil matters invites legitimate public concern,” Nyong’o said.

Call for Respect of Due Process

Nyong’o also defended Tuju’s public standing, saying the former senior government official deserves to be treated with dignity while the dispute is handled through lawful channels.

“Hon. Raphael Tuju, a former senior public servant who has served this country at the highest levels of leadership, is neither a fugitive nor a criminal deserving of humiliation or public embarrassment,” he said.

He stressed that public authorities must exercise restraint and respect due process regardless of the individuals involved.

“Whatever the merits of the commercial dispute, those entrusted with public authority must exercise it with restraint, legality, and respect for due process,” Nyong’o added.

Warning Over Impact on Investor Confidence

The Kisumu governor warned that such incidents could damage Kenya’s reputation and undermine investor confidence if institutions are seen to act arbitrarily.

“Investor confidence, public trust, and Kenya’s broader ambition to position itself among the world’s leading economies cannot flourish where arbitrariness and excess prevail,” he noted.

Nyong’o argued that Kenya’s institutions must inspire confidence if the country hopes to achieve its economic transformation goals.

Appeal for Justice and Rule of Law

Nyong’o concluded by emphasizing that justice must apply equally to all citizens, regardless of status or political affiliation.

“Ultimately, every Kenyan, regardless of status, creed, or political inclination, deserves fair and just treatment under the law,” he said.

He also invoked the country’s national ideals, warning against abandoning the principle of justice.

“The solemn pledge contained in our national anthem, ‘Haki iwe ngao na mlinzi’ (justice be our shield and defender), risks becoming not a guiding national principle, but merely words we recite,” Nyong’o stated.
