Gaucho Qualifies to Serve on Mama Lucy Hospital Board, Here’s What the Law Says

The appointment of Calvince Okoth, popularly known as Gaucho, to the Mama Lucy Kibaki Hospital Board has sparked public debate.

However, the Facilities Improvement Financing Bill, 2023 clearly defines who qualifies to serve on a Hospital Management Board and how it operates.

The law provides that county and sub-county hospitals operate under a board appointed and gazetted by the County Executive Member for Health.

It also limits the board to not more than seven members.

Composition of the Hospital Management Board

The Bill sets out the structure of the board as follows:

  • The in-charge of the health facility, who shall be ex officio and the Secretary to the Committee
  • The Sub County Medical Officer of Health or their representative
  • A village representative
  • One person, who is a resident of the area, nominated by a joint forum of women’s organizations in the area and appointed by the county executive committee member
  • One person, who is a resident of the area, nominated by a joint forum of youth organizations in the area
  • One person, who is a resident of the area, nominated by a joint forum of faith-based organizations
  • Two people representing the interest of the vulnerable and marginalized communities

The Chairperson of the Committee shall be elected from amongst the members of the Committee.

This structure balances technical leadership with community representation. It also strengthens public participation in hospital management.

Where Gaucho Fits in the Law

Calvince Okoth Gaucho fits under the non-technical and representative categories in the law.

“The Act provides for one person, who is a resident of the area, nominated by a joint forum of youth organizations in the area and also includes representation for persons with disabilities within the board structure,” the Law states.

“The law provides for two persons representing the interests of the vulnerable and marginalized communities,” it adds.

These roles ensure that residents take part in planning, budgeting, and oversight of health services.

What these Positions Mean

If Gaucho serves under the youth and disability category, he will represent youth concerns and disability inclusion in hospital governance. He will also take part in planning and monitoring service delivery.

On the other hand, if he serves under community representation, he will link residents with hospital management. He will also participate in public engagement and raise community concerns at the board level.

In both cases, the roles focus on representation and accountability. They do not require medical or technical expertise.

What the board does

The Hospital Management Board plays a key oversight role. It reviews and approves annual work plans and budgets. It also ensures implementation follows available resources.

Furthermore, the board monitors Facility Improvement Financing funds. It also enforces compliance with procurement and financial regulations.

In addition, the board promotes transparency. It connects the hospital with the community and strengthens service delivery.

Why Representation Matters

The law prioritises inclusion in hospital governance. It brings in youth, persons with disabilities and community voices.

As a result, hospitals reflect the needs of the people they serve. They also improve accountability in decision-making.

In this case, Calvince Okoth Gaucho qualifies under Sections that allow youth and community representation. Therefore, his appointment fits within the legal framework that governs Hospital Management Boards.
