Kenya Human Rights Commission (KHRC) has stated that it will take legal action against United Democratic Alliance (UDA) and some of its officials over failure to remit Ksh 69 million worth of taxes and misuse of public funds.
In a statement on April 26, KHRC said that according to a report by the Auditor General, UDA had failed to submit PAYE tax, yet it spent more than Ksh 128 million on paying net salaries and had failed to make deductions or remissions to that account.
The commission claimed that they did this to pass the unpaid bills onto the 2023-2024 and 2024-2025 financial years.
KHRC further noted that UDA was the beneficiary of a political party’s fund that cost Kenyan taxpayers more than Ksh 789 million during the 2025-2026 financial year, yet it was a party that could not abide by statutory requirements.
“Public money should be accountable to Kenyans to the highest standard, and every Kenyan has a right to transparency,” said KHRC.
The commission also stated that the political party failed to submit withholding tax and the public procurement capacity-building levy, which the Public Finance Management Act mandates.
As well as the contributions required under the National Social Security Fund (NSSF) and Social Health Insurance Fund (SHIF) Act, which exposed employees to the danger of losing their social benefits.

According to the KHRC, several laws have been violated by UDA, which include some under the Income Tax Act, Affordable Housing Act, and NSSF Act.
They claim that by failing to meet statutory requirements for these vital sectors, like health and education, they are already being hurt by gaping funding gaps.

KHRC has called upon the Kenya Revenue Authority (KRA), Registrar of Political Parties, and the Ethics and Anti-Corruption Commission (EACC) to look into the matter and enforce compliance.
