Motorists Raise 7 Questions Over NTSA’s New Instant Fines System

The Motorists Association of Kenya (MAK) has written a letter seeking clarification on the newly introduced instant fines management system.

Copied to the National Council on the Administration of Justice (NCAJ), the letter raises legal concerns about how the new system will be implemented.

MAK questions whether the system could bypass existing judicial procedures, noting that fines have traditionally been handled in courts.

The association points out that the notice leaves several questions unanswered, particularly regarding how motorists can address fines.

It also expresses concern that automated traffic enforcement may merge investigative and judicial roles, potentially affecting due process and fairness for motorists.

MAK calls for clear guidelines to protect drivers’ rights and asks the NTSA to clarify the procedure for motorists who wish to appeal penalties or plead not guilty to offences issued under the instant fines system.

Questions on Accountability

The Association also asked for details about the technology used in the process, including the cameras and other automated devices.

Moreover, the lobby group also asked whether enough public participation was conducted before implementing the new digital framework.

New system targets traffic offences

The Instant Fines Traffic management system, recently launched by NTSA automatically detects traffic offences and sends notifications to motorists via SMS.

Drivers are to pay the fine within 7 days; failure to which additional charges being added.

Authorities say the new system is designed to promote transparency and efficiency in traffic enforcement, while on the other hand reducing corruption.

However, MAK has asked NTSA to respond to their concerns within 48 hours, indicating the high public interest surrounding the matter.
