Tension gripped the precincts of the Milimani Law Courts on Monday after veteran medic Dr. Job Lukuru Obwaka, the 80-year-old chair of the board at The Nairobi Hospital, developed sudden health complications while awaiting arraignment in a high-profile governance dispute involving the institution.
Dr. Obwaka reportedly fell ill while being held in a Directorate of Criminal Investigations vehicle together with other hospital officials who had been brought to court ahead of the anticipated reading of charges.
According to preliminary reports, the elderly doctor was rushed to receive emergency medical attention in an ambulance as his condition worsened before he could be formally presented before a magistrate.
The medical emergency triggered anxiety among lawyers, doctors and supporters gathered outside the court premises, many of whom had turned up in solidarity with the veteran obstetrician and gynaecologist who has served Kenya’s medical sector for decades.
Dr. Obwaka had been transported to court after spending the weekend in police custody following his arrest alongside other officials linked to the management of the hospital.
Detectives from the Directorate of Criminal Investigations escorted the officials to court early Monday morning as they awaited formal charges.
Reports indicate that lawyers representing the detained officials informed the court that the senior medic required urgent medical attention and that an ambulance had been placed on standby as his condition deteriorated.
Colleagues within the medical fraternity have raised concern about his health, noting that the elderly doctor has a complicated medical history and had previously undergone open-heart surgery, making prolonged detention a major concern.
Professional bodies in the healthcare sector have since called on authorities to ensure that due process is followed in this matter, as well as his health and dignity during the legal proceedings.

The appearance of the officials in court arises as a result of an increasing legal tussle over the leadership and management of the Kenya Hospital Association, which owns and manages The Nairobi Hospital.
The officials are alleged to have fraudulently manipulated the association’s membership register.
According to the charge documents drawn up by investigators, the charges against the officials include the alleged procurement of the registration of 334 individuals as members of the association under false pretences between July and December 2024.
The manipulation of the association’s membership register is considered significant as the association’s members are considered instrumental in the determination of leadership and management of The Nairobi Hospital.
The officials are also alleged to have failed to lodge amended articles of association and other statutory documents with the Registrar of Companies as required under the Companies Act.
The officials are denying the charges and are expected to contest them in court.

The ongoing case at the Milimani Law Courts is just one of the events in what has been a long-running crisis at one of the most prestigious private healthcare institutions in East Africa.
The Nairobi Hospital, which has been in operation for decades as one of the most respected private healthcare facilities in Kenya, has been in the midst of internal conflicts regarding control, legitimacy, and decision-making by various parties in the Kenya Hospital Association.
Court cases in relation to governance at the hospital have in recent times been on the increase, with various parties contesting the legitimacy of various membership registers and decisions by various parties in charge.
At one point, the High Court even stepped in to address various issues in relation to the hospital’s leadership and various investigations in relation to the crisis.
However, the arrest of various officials in relation to the crisis has come in for some criticism from various parties in the medical and legal professions.
Various parties, such as the Kenya Medical Practitioners, Pharmacists, and Dentists Union, have indicated that if certain issues in relation to due process are not addressed, they might lead to more tensions in the medical fraternity.
