Four County Officials Face Manslaughter Charges Over South C Building Collapse

The Director of Public Prosecutions (DPP) has today arraigned four officials linked to the Nairobi County Government over the fatal collapse of the Mamliz Towers construction project in South C, Nairobi.

The four appeared before the Milimani Chief Magistrate’s Court, where they were charged with manslaughter and other offences arising from the deadly incident that claimed two lives earlier this year.

Abdishakur Muse Mohammed, Yussuf Mohammed Yussuf, Daniel Alphonse Odhiambo and Gideon Chege Gakundi, also known as Gideon Chege Mwangi, appeared before Milimani Chief Magistrate Caroline Mugo, where they faced two counts of manslaughter.

The prosecution accused the four of unlawfully causing the deaths of two victims following the collapse of the Mamliz Towers building on January 2, 2026.

“The Director of Public Prosecutions has today arraigned four officials linked to the Nairobi County Government over the fatal collapse of the Mamliz Towers construction project in South C, Nairobi. Abdishakur Muse Mohammed, Yussuf Mohammed Yussuf, Daniel Alphonse Odhiambo and Gideon Chege Gakundi, also known as Gideon Chege Mwangi, appeared before Milimani Chief Magistrate Caroline Mugo, where they were charged with two counts of manslaughter,” the prosecution said in a statement.

Charges of Manslaughter Arising from Mamliz Towers Collapse that Resulted in Deaths

The DPP further alleges that the tragic event took place on January 2, 2026, in South C, Lang’ata Sub-county, Nairobi County, through the collapse of the Mamliz Towers building, which led to the death of two people named Ali Adan Galgalo Abdi and Hassan Huka.

“The deaths of Ali Adan Galgalo Abdi and Hassan Huka were caused by the accused on the 2nd of January 2026, at South C, Lang’ata Sub-county, Nairobi County, through the collapse of the Mamliz Towers building,” DPP stated.

Additional Forgery Charges Against Two Accused

Apart from the manslaughter counts, the prosecution preferred additional charges against Abdishakur Muse Mohammed and Yussuf Mohammed Yussuf for the alleged forgery of official planning documents related to the development.

“In addition to the manslaughter charges, the DPP charged Abdishakur Muse Mohammed and Yussuf Mohammed Yussuf with making a document without authority, contrary to Section 357(a) of the Penal Code,” the prosecution stated.

The court heard that the two accused allegedly prepared a fraudulent approval document purporting to authorise changes to the development’s land-use application.

“On 23rd March 2023 at an unknown location within the Republic of Kenya, the two accused, without lawful authority or excuse, fraudulently made a notification approving Application No. PLUPA-BPM-002115N, purporting to authorise a change of user for the development,” the prosecution alleged.

Court Hears of Alleged False Document Upload

The prosecution further informed the court that the two officials later used the allegedly forged document during the project’s registration process with the National Construction Authority (NCA).

“The two face a further charge of uttering a false document. On 4th November 2023, at the National Construction Authority offices in Nairobi County, they knowingly and fraudulently uploaded the forged approval notification onto the National Construction Authority’s online project registration portal, falsely presenting it as a genuine document issued by the Nairobi City County Government,” the prosecution noted.

Accused Denies All Charges

When the charges were read before Chief Magistrate Caroline Mugo, all four accused persons denied the allegations levelled against them.

“All four accused persons pleaded not guilty to the charges,” ODPP stated.
