Former Sports PS & 9 Others Charged Over KSh330 Million CHAN Scandal

Former Sports Principal Secretary Peter Kirimi Kaberia and nine others are set to face graft charges over the alleged misappropriation of Ksh 330 million meant to prepare Kenya for the 2018 Africa Nations Championship (CHAN).

The charges were approved by the ODPP in a statement dated 7 September 26, following investigations by the Ethics and Anti-Corruption Commission (EACC).

“The Director of Public Prosecutions (DPP) has approved graft-related charges against former Sports Principal Secretary, Amb. Peter Kirimi Kaberia, alongside four former government officials and five businessmen, in connection with the alleged misappropriation of Ksh.330 million allocated for Kenya’s preparations to host the 2018 Africa Nations Championship (CHAN).” The statement read.

The suspects are said to include senior officials of the former Ministry of Sports and directors of private companies said to be associated with the transactions.

They have been slapped with charges of abuse of office, unlawful acquisition of public property, failure to comply with procurement laws, acquisition of proceeds of crime, and financial misconduct.

Five companies have also been listed for prosecution, including Auditel Kenya, Taxwise Consulting Limited, Restea Enterprises Limited, Lease Pride Limited, and Leasepath Limited.

The individuals to be charged are:

• Amb. Peter Kirimi Kaberia – Former Principal Secretary, Ministry of Sports
• Stephen Njoroge Muthuma – Senior Principal Finance Officer, Ministry of Sports
• Harun Chebet Komen – Director of Administration, Ministry of Sports
• Enock Ondwari Onditi – Principal Accountant, Ministry of Sports
• John Kiende Ruga – Senior Superintendent Engineer, Ministry of Sports
• Marcos Gonzalez Puente – Director, Auditel Kenya
•  Samuel Mbaa Njoroge – Director, Taxwise Consulting Limited
• Kitheka Muema – Director, Restea Enterprises Limited
• Anthony Mwangi Kimanthi – Director, Lease Pride Limited
• Ephrahim Kinyua Muchangi – Director, Leasepath Limited

Corruption Prosecution Charges

According to the ODPP, “the defendants and institutions are to be charged with abuse of office, unlawful use of public funds, failure to adhere to procurement laws, receipt of stolen funds, and financial misconduct.”

After the investigation, the board found enough evidence to prosecute the suspects and companies involved.

Legal Prosecution Procedures

The ODPP stated that the charges stem from investigations conducted by the EACC, which submitted its inquiry file to the ODPP for review and guidance on the accused persons.

The ODPP reaffirmed its commitment to upholding the rule of law, safeguarding public resources, promoting integrity, and ensuring accountability in the management of public affairs.
