The ruling United Democratic Alliance (UDA) led by President William Ruto has broken its silence following a High Court decision declaring the alleged merger between the party and the Amani National Congress (ANC) unconstitutional.
In a statement issued on Thursday, January 22, UDA Deputy Party Leader Issa Timamy dismissed the ruling, arguing that there was never a merger between the two parties but a voluntary dissolution of ANC.
“I have taken note of the High Court ruling on Thursday, January 22, on the “Matter of ANC Party having “merged” with the ruling party, United Democratic Alliance (UDA). I would like to state categorically that the court ruling on the purported ANC-UDA merger is a matter that events have overtaken,” read part of the notice.
The party maintained that ANC formally dissolved in February 2025, with its members and assets lawfully integrated into UDA in accordance with the Political Parties Act.
According to a UDA party official, who served as the acting leader of the Amani National Congress (ANC) after Musalia Mudavadi stepped down when he was appointed Prime Cabinet Secretary, the ANC underwent a voluntary dissolution rather than a merger.

The party stated that it formally dissolved in February 2025 following a Special National Delegates Congress. This decision was officially documented on March 14, 2025, via Gazette Notice No. 3448, issued by the then Registrar of Political Parties, Ann Nderitu.
Timamy stressed that because the ANC dissolved in accordance with its own constitution and the Political Parties Act, the court’s attempt to nullify a “merger” was based on a “fiction.
“You cannot nullify a decision that never existed in the first place,” the statement read.
The UDA further clarified that following the 2025 dissolution, all ANC assets were lawfully transferred to the UDA. Additionally, former ANC members were fully integrated into the ruling party through established legal procedures. The party insists that there is currently no parallel structure or legal ambiguity regarding the status of these former ANC members within the UDA.

Despite the legal setback in court, the UDA maintains that its primary focus remains on political consolidation and national development. The party expressed its commitment to:
