Judiciary Issues Emergency Measures for Thika Court after Protests

The Judiciary has announced emergency measures for the Environment and Land Court (ELC) in Thika, effectively scaling back physical operations due to what they described as serious occupational health, safety, and service-delivery concerns.

According to the press statement signed by Chief Registrar of the Judiciary Winfridah B. Mokaya on February 14, 2026, the decision comes after a major construction project currently ongoing in proximity to the court premises.

The report indicated that the works are generating significant dust and debris, adversely affecting air quality and creating a material health and safety hazard for Judges, judicial officers, staff, advocates, and court users, particularly vulnerable persons, including children, older persons, and those with underlying respiratory conditions.

The statement further said the construction is disrupting the court environment by undermining the dignity of service and creating conditions that are inconsistent with the standards expected of a court station.

A “Toxic” Environment for Justice

The situation is further exacerbated by the County Government’s use of the court’s immediate vicinity as a parking point for garbage collection trucks.

“The same location is used by the County Government as a parking point for garbage collection trucks, resulting in persistent foul odour, hygiene concerns, and an overall environment that is unsuitable for sustained court operations and public access to justice,” part of the statement read.

Protests and Immediate Action

The announcement follows a peaceful march held on Friday, February 13, by members of the Law Society of Kenya (LSK) to raise awareness about the deteriorating conditions.

“We acknowledge the peaceful march held by a number of Law Society of Kenya (LSK) members yesterday to raise awareness regarding these concerns. The Judiciary treats the matter as urgent given its implications for staff welfare, public health, institutional integrity and continuity of justice services,” statement read.

A high-level Court Users Committee (CUC) meeting is scheduled for Wednesday, February 18, 2026, to coordinate a multi-agency way forward.

The Judiciary has urged LSK representatives to participate fully to ensure the safety and continuity of justice services.
