ODM in Fresh Row Over Proposed Deputy Role for Winnie Odinga

The Orange Democratic Movement (ODM) has faced a legal battle after a petition challenged plans to create an additional top leadership position linked to Winnie Odinga.

The case, filed at the Political Parties Disputes Tribunal (PPDT), comes just days before the party’s National Delegates Conference (NDC), raising tensions over internal leadership arrangements.

According to the case,  the petitioner argues that the proposed deputy party leader role violates ODM’s constitution and could undermine fair internal elections.

“The election of deputy party leaders may be unduly influenced by the pre-emptive endorsement made at the county-level meeting of 17th March, contrary to Articles 6.2.2 and 6.2.2(e) of the Party Constitution.” The application stated.

The dispute follows a March 17 county-level meeting in Nairobi, where grassroots delegates endorsed Winnie Odinga for a senior leadership role.

Concerns Over Party Structure

The petitioner warns that the proposed changes could have lasting effects on ODM’s internal governance.

“An unconstitutional precedent of dynastic succession will be established within the Party, whereby party positions may be ‘inherited’ by family members of deceased leaders outside the constitutional electoral processes,” Amuga stated.

“The integrity of the National Delegates Conference as the supreme organ of the Party with exclusive authority to elect National Officials under Article 7.2.4(g) will be irreversibly undermined.” He added.

NDC Authority Questioned

The petition clarifies that the case does not block participation in the NDC but ensures adherence to the party constitution.

“The 2nd Respondent will still be entitled to attend and participate in the convention as an EALA MP delegate; the orders sought merely prevent her from claiming a position that does not exist in the party constitution,” Amuga stated.

As ODM navigates leadership succession after the long-standing influence of Raila Odinga, Winnie Odinga’s growing grassroots support has placed her at the center of the party’s evolving power dynamics.

With the NDC approaching, the tribunal’s decision will determine whether the proposed leadership changes proceed or stall, shaping ODM’s direction in the coming months.
