High Court Temporarily Freezes Githunguri Housing Project

The Environment and Land Court in Thika has temporarily suspended construction on a 58-acre Githunguri affordable housing site, following a petition by cultural elders and heritage groups.

The court action responds to claims that the land, known as Githunguri Kia Wairera, serves as a sacred ancestral shrine and a historical Mau Mau site.

The suspension does not permanently halt the project. Instead, the court issued conservatory orders to maintain the current condition of the land while the petition proceeds.

The matter will return to court for a full hearing on July 6, 2026, giving both sides a chance to present evidence.

Elders Warn of Cultural Loss

The petitioners, led by the Kikuyu Council of Elders, argued that the housing project threatens Kenya’s cultural heritage.

They claimed that the ancestors’ graves and Mau Mau historical sites lie within the development area.

“This land holds the memories and sacrifices of our forebears,” said Wachira Kiago, Council Chairman.

“If developers proceed without proper preservation, they will erase an important part of our identity,” he added.

The elders also criticized the government for insufficient community engagement.

They argued that authorities overlooked proper public participation before approving the housing project, which plans to construct over 2,000 affordable units.

Court Orders Status Quo Ahead of Hearing

Justice Dorah Chepkwony emphasized that the court must fully examine evidence before making a final decision. She directed that developers pause construction until the July hearing.

This temporary measure ensures the land remains unchanged while the case is reviewed.

Lawyers representing the petitioners welcomed the ruling.

“The court acknowledged the urgency of our concerns,” one counsel said.

“This order prevents irreversible damage before the full case is heard,” they added.

Government Pushes Housing Initiative

The national and county governments argued that the affordable housing project addresses Kenya’s severe housing deficit.

Officials said they conducted surveys and environmental assessments before approving the site. They also pledged to work with communities to respect cultural concerns while delivering the housing plan.

The dispute highlights the delicate balance between development and heritage preservation.

As the case continues, stakeholders from both sides are preparing detailed evidence and testimony for the full court hearing later this year.
