Court Stops Controversial Affordable Housing Project

The High Court in Kiambu has issued orders stopping construction of a disputed affordable housing project in Githunguri, deepening a growing standoff between the government and Agikuyu elders over land ownership and cultural claims.

In a decision delivered by Justice Bahati Mwamuye, the court instructed the contractor involved in the project to immediately cease all building works on the contested 58-acre property and vacate the site at once.

The court also directed that the perimeter wall already constructed around the land be brought down, while ordering that the current state of the property be preserved until the matter is heard and determined.

“The respondents, together with their agents, servants, and/or associated persons, are to immediately remove all machinery, equipment, and remove all fencing from the aforementioned sites and to immediately restore the status quo ante as it obtained immediately before the impugned actions pending the full hearing and determination of the Petition herein”, reads part of the court order.

Rising Tensions Over Sacred Land

The court’s decision follows escalating tensions between government officials and members of the Agikuyu community, who have maintained strong opposition to the development, citing cultural significance and historical ties to the land.

The standoff intensified last week after elders seeking entry to the property to conduct traditional rites were reportedly denied access by police officers stationed at the site to provide security.

Despite being denied entry , the elders carried out symbolic rituals along the roadside, including smashing a calabash-an act they said represented a curse against individuals they accuse of ignoring and undermining Kikuyu cultural heritage.

Symbolic Rituals and Cultural Significance

The disputed property, commonly referred to as Githunguri Kia Wairera, is widely considered an important ancestral shrine, holding profound cultural and spiritual value for the Kikuyu community.

Community elders have also linked the land to the colonial period, saying it is believed to be the site where at least 54 Mau Mau fighters were killed, giving it lasting historical importance as a place associated with struggle and sacrifice.

The petition was lodged by lawyer Njoroge Mwangi together with the Agikuyu Council of Elders and several community lobby groups, who argued that authorities moved ahead with the multi-million housing development without carrying out meaningful public participation.
