Court Jails Man for Life Over Sexual Offences Against Minors

The Office of the Director of Public Prosecution (ODPP) has secured a life sentence and conviction on a defilement and sexual assault case in Turkana County.

The Lodwar Magistrate’s Court convicted a man after finding him guilty of defiling and sexually assaulting two minors, aged nine and six years old.

The court heard this case on July 17th, 2023, up to July 19th, 2023, at Nakwamkwi in Turkana Central Sub-county.

Upon hearing, the suspect was a neighbour of the minors who tricked them into his house by offering them yoghurt and sweets.

“The court heard that on diverse dates between July 17, 2023, and July 19, 2023, at Nakwamkwi in Turkana Central Sub-County, the accused, who was a neighbour, lured the two young girls to his house by offering them yoghurt and sweets,” said DPP.

How The Victims Testified Before The Court

According to the 9-year-old victim, the suspect lured him to his residence, where he committed the indecent act upon her.

The 6-year-old victim added that she saw the man committing an indecent act, and after finishing, she assaulted her.

The minors’ testimony was supported by medical evidence and a neighbour who witnessed the 9-year-old girl running while scared from the accused’s house.

“The 9-year-old victim testified that the defendant lured him to his residence, where he committed the indecent act upon her, providing a detailed description of the incident. The 6-year-old victim testified that she saw the defendant commit the act and later assaulted her,” DPP added.

Lead Counsel Robert Otieno and Baranga Limo presented five witnesses whose testimonies successfully established the accused’s guilt beyond a reasonable doubt.

How The Accused Defended Himself Before The Court

According to the accused, he was in Bungoma County at the time this incident happened, a statement that the court dismissed.

He added that there’s no hard evidence from the prosecution’s witnesses, who included minors’ credible and content testimonies.

How The Judge Ruled on This Case

N.M. Idagwa ruled that the accused was a positively identified minor because he was their neighbor, known to them.

With the satisfactory evidence presented in court, the accused was found guilty and sentenced to life imprisonment.

“N.M. Idagwa ruled that the accused was positively identified by the minors, as he was a neighbour known to them, making it a case of recognition. Satisfied with the evidence, the court found the accused guilty and sentenced him to life imprisonment,” DPP stated.
