Court Gives Directions in Case Challenging KRA Commissioner General Appointment

The High Court in Nairobi has issued directions in a petition filed by the Consumers Federation of Kenya challenging the appointment of Adan Abdulla Mohamed as the Kenya Revenue Authority (KRA) Commissioner General.

Justice Gregory Mutai issued the directions on August 2, 2026, after reviewing a petition and a Notice of Motion application both dated July 29, 2026.

The petition, filed as HCCHRPET/E507/2026, seeks to nullify the appointment of Adan Abdulla Mohamed.

The court confirmed that the case directly challenges the legality of the appointment.

“I have perused the Petition and the Notice of Motion application, both dated 29th July 2026, as well as the documents attached thereto. I note that the Petition impugns the appointment of the Interested Party as the Commissioner General of the Kenya Revenue Authority and seeks to have it nullified,” Justice Mutai stated.

Court Notes Similar Case on Adan Abdulla Mohamed Appointment

Meanwhile, the court noted that it is already handling another petition involving the same subject matter.

The court referenced Petition No. E311 of 2026, Bernard Opere v The Cabinet Secretary, Treasury and 5 others, which also challenges the KRA Commissioner General appointment. That case is scheduled for mention on October 13, 2026.

“This Court is currently handling a similar matter, to wit Petition No E311 of 2026; Bernard Opere v The Cabinet Secretary, Treasury and 5 others, in respect of the same subject matter. The said Petition is due for mention on 13th October 2026,” Justice Gregory Mutai stated.

Parties Given Timelines to Respond

Following the directions, the court ordered the petitioner to serve the petition and the Notice of Motion on the respondents and the Interested Party within three working days, in both soft and hard copies.

The petitioner must then file an affidavit of service to confirm compliance.

The respondents and the Interested Party will have 14 days from the date of service to enter appearance and file their responses.

The court further directed the petitioner to file replies, if necessary, together with written submissions within 14 days of receiving the responses.

They will then have a further 14 days to file written submissions in opposition after receiving the petitioner’s filings.

Finally, the court scheduled the matter for mention on October 13, 2026, to confirm compliance and give further directions.
