15 DCI, NIS Officers Face New Charges Over Kidnapping of Indian Nationals

The Office of the Director of Public Prosecutions (ODPP) has filed 17 new charges against 15 officers attached to the Directorate of Criminal Investigations (DCI) and the National Intelligence Service (NIS) over the alleged 2022 kidnapping of two Indian nationals and their Kenyan driver.
According to a statement dated August 27, the suspects are Peter Gachiku, James Tanki, Joseph Mbugua, David Kipsoi, Joseph Mbaya, John Kamau, Hillary Kipchumba, Stephen Matunda, Simon Gikonyo, Paul Muriithi, Bonface Mtulia, Elikana Mugendi, Fredrick Kamau, John Mavhari and Michael Bett.
The ODPP said the suspects are expected to appear before Senior Principal Magistrate Njeri Thuku at the Kahawa Law Courts on September 7, 2026, for plea-taking.
ODPP Files 17 New Charges Against DCI &NIS Officers
The suspects will face charges including kidnapping with intent to murder, contrary to Section 258 of the Penal Code, and conspiracy to commit a felony, contrary to Section 393 of the Penal Code.

In addition, the ODPP said the officers will also face charges relating to allegedly subjecting a person to cruel, inhuman or degrading treatment under Section 51(3) of the National Intelligence Service Act, No. 28 of 2012.
“The suspects will face charges including kidnapping with intent to murder, contrary to Section 258 of the Penal Code; conspiracy to commit a felony, contrary to Section 393 of the Penal Code; and subjecting a person to cruel, inhuman or degrading treatment, contrary to Section 51(3) of the National Intelligence Service Act, No. 28 of 2012,” read part of the statement.
The charges also include allegations of forgery, committing cruel, inhuman and degrading treatment, and cooperating in the execution of such treatment.
Meanwhile, the prosecution team comprises Victor Owiti, Betty Rubia, Bridgit Atieno, Anthony Musyoka, James Machirah, Kennedy Amwayi and Harrison Kiarie.
How the 2022 Kidnapping Allegedly Happened
The prosecution alleges that the incident occurred on July 22, 2022, in Nairobi County when the suspects were travelling in four motor vehicles alongside other individuals whose identities have not yet been disclosed.
According to the ODPP, the group allegedly trailed and intercepted a vehicle carrying Mohammed Zaid Sami Kidwai and Zulfiqar Ahmed Khan, both Indian nationals, and their Kenyan driver, Nicodemus Mwania Mwange.

As a result, the three were allegedly kidnapped during the incident, leading to the prosecution of the 15 officers.
The latest charges were filed after the High Court terminated earlier murder proceedings against the accused officers.
ODPP noted that termination allowed the prosecution to pursue fresh charges based on the evidence available in the case.
“The new charges were filed after the High Court terminated the earlier murder proceedings against the accused persons, paving the way for the prosecution to institute fresh charges based on the available evidence.”
