FACT CHECK: Victoria Ndunge Musyoki Jailed After Failing to Repay Ksh15M in Mutula Kilonzo Jr Case

Claims that Victoria Ndunge Musyoki has been arrested after failing to repay Ksh 15 million to Makueni Governor Mutula Kilonzo Jr. have resurfaced, almost a year after she was jailed over the long-running paternity dispute.

Musyoki was arrested in 2025 after failing to honor a court order requiring her to refund Kilonzo money he had paid towards the upkeep of a child he believed was his.

Hivileo has established that the arrest being referred to in the latest reports is not a new development. It happened in 2025, when Musyoki was taken to Lang’ata Women’s Prison as the two sides negotiated how she would settle the debt.

Court battle over child support

The dispute began in 2016 when Musyoki sued Kilonzo at the Milimani Children’s Court, claiming he was the father of her child and seeking maintenance, including money for education and medical expenses.

Kilonzo disputed the claim and later asked the court to order a DNA test to determine the child’s paternity.

The test eventually established that he was not the biological father. In 2023, the court ordered Musyoki to refund Ksh15 million that Kilonzo had paid towards the child’s support.

After she failed to comply with the order or present a settlement plan, the court issued a warrant of arrest. She was eventually arrested and presented before the court.

In June 2025, her lawyer asked for her release, arguing that keeping her in custody would make it harder for her to sell property and raise the money. The court declined the request, and she was remanded at Lang’ata Women’s Prison for nearly two months.

Musyoki Released After Agreeing to Sell Property

On September 25, 2025, the parties reached a consent agreement that was adopted by the court.

Under the agreement, Musyoki admitted owing Ksh15 million and agreed to pay a further Ksh 345,000 in bailiff’s costs.

She undertook to sell her Donyo Sabuk/Donyo Sabuk West Block 1/385 property within 90 days to raise the money.

The court subsequently released her from custody under the agreement, warning that failure to comply could result in renewed arrest and attachment of her property.

A report published on October 5, 2026 has now brought the case back into the spotlight, recounting the arrest and imprisonment as part of the decade-long dispute.

Hivileo found no indication in the available reports of a fresh arrest in 2026. The arrest, imprisonment and subsequent release documented in the case all occurred in 2025.
