Death Penalty for Two Men Who Robbed Boda Boda Rider and Forced M-Pesa Withdrawal

A court in Wajir sentences two men to death; this is after they were found guilty of robbing a boda boda rider and threatening to kill him.

According to the Office of the Director of Public Prosecutions (ODPP), Senior Principal Magistrate Eric Malesi convicted Abdiaziz Ali Ahmed and Abdiwahab Mohamed Hassan.

The two men were charged with robbery with violence, which is contrary to Section 296(2) of the Penal Code.

In the statement by ODPP, Abdiaziz also faced an alternative charge of handling stolen property, which is contrary to Section 322(1) as read with Section 322(2) of the Penal Code.

Witnesses

Three witnesses were produced alongside other evidence by the prosecution, which was led by Assistant DPP Robert Nyoro.

The court ruled that the testimonies of the witnesses and the evidence provided clear evidence that guaranteed the conviction and sentencing of Abdiaziz and Abdiwahab.

On the other hand, the court heard that on the night of November 13 2025, at about 9.30 p.m. The complainant, Nesia Thuranira, was riding his motorcycle along Baraza Park Road in Wajir.

During that time, two men who are now the accused approached him pretending to be passengers while he was completely unaware they were robbers.

Day Of Robbery

After a few minutes, five other men who were armed also emerged from a nearby corridor and surrounded him.

The gang was allegedly armed with knives, which they threatened to use to kill him if he did not cooperate and take his phone, a Tecno Pop 8, which is valued at approximately Ksh 30,000.

After taking his phone, the gang then forced him to accompany them to a nearby M-Pesa shop owned by Joseph Kimathi, where he took money from his mobile money and gave them.

They forced him to give away his M-Pesa PIN and they eventually managed to withdraw a total of Ksh 15,000.

Thuranira managed to escape for a moment and alerted the M-pesa agent not to give the robbers the money, but they had already acquired Ksh 10,000.

Further, the M-pesa agent was also forced to transfer the remaining money to their mobile phone.

Investigations

While investigations were ongoing, the police established that the number used was registered under one of the accused’s sisters without her knowledge of the matter.

Additionally, the phone that was stolen was later found with the mother of one of the accused.

However, both women linked to the matter refused to testify; the investigating officer already had enough evidence to convict the accused.

After being sentenced, the accused were informed of their right to appeal the case within fourteen days as of the Kenyan Constitution.
