Man Gets Life Sentence After DNA Evidence Links Him to Defilement of 2-Year-Old

The Director of Public Prosecutions (DPP) has secured a life imprisonment sentence against a man who was found guilty of sexually assaulting a two-year-old baby.

According to the DPP, the accused person was convicted by Hon. Githaiga of the Kithimani Magistrate’s Court on September 1, 2026, after the prosecution presented evidence of the crime that was committed on January 6, 2026, in Kiemboni village.

His sentence was granted on the basis of the gravity of the sexual offences against children and the need to protect minors from such offences.

The court charged him with defilement of a minor, which is contrary to Section 8(1) as read with Section 8(2) of the Sexual Offences Act, No. 3 of 2006.

Accused Was Known

Additionally, the conviction was entered by the court under Section 215 of the Criminal Procedure Code.

The prosecution told the court that the accused was well known to the child and her family, meaning the child was familiar with him and trusted him in a way, not knowing he would sexually abuse her.

In addition, the court heard that the minor was later found bleeding and was rushed to the hospital before she later identified the accused through an intermediary.

Medical evidence was presented to the court, which indicated visible injuries to the child’s genitalia, confirming that the accused forcefully penetrated the minor.

Evidence Presented

Investigators of the case also provided the trousers the child was wearing as evidence because it had blood and the accused’s DNA, which was used as evidence.

Evidence that was provided by the prosecution was enough to establish that the accused was guilty beyond reasonable doubt of sexually assaulting the two-year-old minor.

Further, the accused person claimed that he had been falsely implicated over a dispute about a Ksh 5,000 debt that he owed to someone, but the court overruled this.

During sentencing, the court described the offence as grave and aggravated, noting that the accused had sexually assaulted a minor and taken advantage of her vulnerability.

His Sentence

Although the accused was treated as a first offender and pleaded for leniency, the court found that the seriousness of the offence warranted a custodial sentence that would protect children and deter would-be offenders.

The sentence takes effect from January 12, 2026, when he was first arraigned and placed in custody.

He was also ordered to have his name entered in the Register of Convicted and Dangerous Sexual Offenders.
