Win for Kenyans as EACC Recovers KSh 281 Million Public Land

EACC has won several court cases and successfully recovered public lands in Mombasa worth Ksh 281,000,000, and this victory is another giant leap toward eradicating illegal acquisition of public assets.

In consolidated cases ELC 64 and 65 of 2020 as well as ELC 180 of 2015, the Environment and Land Court has upheld the recovery by Kenya Railways Corporation of Mombasa/Block 1/525 and 1/526 located along Shimanzi Road.

The Environment and Land Court found that both parcels had been reserved for the future expansion of roads and axle spacing for existing railways and were illegally allocated in 1994 and had been subsequently transferred to third parties.

The Commission stated that the Court determined the two parcels, “had been reserved for Kenya Railways Corporation and future road expansion,” and ruled that they were, “unlawfully allocated in 1994 and subsequently transferred to third parties,” effectively depriving the public of critical infrastructure land.

Court Cancels Titles and Restores Public Ownership

On February 13, 2026, the Court declared the allocations unlawful, ordered the cancellation of the titles, and directed that the properties revert to public ownership.

According to the Commission, “the Court declared the allocations unlawful, ordered the cancellation of the titles, and directed the restoration of the properties to public ownership.”

The two Shimanzi Road parcels are valued at Ksh 175 million.

In a separate judgment delivered on February 3, 2026, the Court nullified a lease over Mombasa Island/Block XI/937 along Tom Mboya Avenue, formerly Tudor Road, identifying the property as a designated road reserve.

The Commission confirmed that, “the parcel, valued at Ksh 15 million, was ordered to revert for public use.”

The anti-graft agency further disclosed that it has recovered additional parcels along the same corridor valued at Ksh 91 million, bringing the total value of land reclaimed in the matter to Ksh 281 million.

Asset Recovery Central to Anti-Corruption Drive

“These recoveries underscore the Commission’s ongoing commitment to asset recovery as a central pillar in the fight against corruption,” the agency said, emphasizing that reclaiming grabbed public assets remains a strategic priority.

Over the past year, the Commission has filed more than 79 recovery suits seeking assets valued at approximately Ksh 4.8 billion.

It has successfully recovered Ksh 3.4 billion through court processes and negotiated settlements.

Reiterating its position, the Commission stated that it remains firmly resolved “to recover illegally acquired public assets” and urged, “individuals and entities in possession of such properties to voluntarily surrender them for their intended public use.”
