FKF vs Mariga Takes New Twist After Tribunal Issues Urgent Orders

The Sports Disputes Tribunal(SDT) has issued a temporary order suspending disciplinary proceedings by the Football Kenya Federation (FKF) in a case involving Macdonald Mariga Wanyama.
In a ruling issued by Deputy Chairperson Allan Mola Owinyi, the Sport Tribunal certified the application dated May 21, 2026, as urgent and directed that it be handled on a priority basis.
The court added that it had reviewed the Certificate of Urgency, Notice of Motion, and supporting affidavit filed by Macdonald Mariga Wanyama, alongside accompanying documents.
“UPON READING the Certificate of Urgency dated 21st May 2026, the Notice of Motion of even date, the Supporting Affidavit of Macdonald Mariga Wanyama and all annexures thereto;AND UPON CONSIDERING the grounds set out therein,AND UPON BEING SATISFIED that the matter discloses sufficient urgency and that the Applicant has demonstrated a prima facie case warranting the grant of interim protection;” read the ruling.
SDT Temporarily Stops FKF Disciplinary Process Against Mariga
Sports Dispute Tribunal granted a temporary injunction stopping FKF from continuing or initiating any disciplinary proceedings against the Applicant.
The order suspends proceedings that had been commenced through a charge sheet dated May 19, 2026, pending the full hearing and determination of the case.

The SDT further barred the Respondent from proceeding with any related disciplinary action, whether initiated by FKF or any other party, until the matter is fully heard.
Allan Mola Owinyi also directed all applicants to serve all relevant documents and the interim orders to the Respondent and Interested Party by 5:00 p.m. on May 22, 2026.
“The Applicant shall serve the Application, the Supporting Affidavit and these interim orders upon the Respondent and the Interested Party by 5:00 p.m on 22nd May 2026,” read part of the ruling.
Mariga Seeks Help from SDT to Avoid Discliplinary Actions
Meanwhile, SDT highlighted that FKF and other involved parties are required to file and serve their responses within seven days of being served.
This comes after Mariga sought relief from SDT after the federation instituted disciplinary proceedings on the basis of a complaint launched by Migori branch chairperson Bernard Odongo.
According to Mariga’s testimony, a stunning claim was made over the FKF-CAF Ecobank account, which served as the primary vehicle for funds related to the tournament.

The dispute stems from the fallout between Mariga and FKF president Hussein Mohammed after Mariga chaired a National Executive Committee (NEC) meeting on April 23 that resolved to oust Mohammed from office.
However, the supremo dismissed his ouster, pointing to FKF’s constitution, which confers him – and not any other – the powers to call such a meeting.
As a result, Mohammed has gone to the SDT as well as the High Court, both of which have barred his ouster by issuing interim conservatory orders.
