What He Posted About Senator Tom Ojienda on Facebook Has Now Landed Him in Court

A man has been presented before the Milimani Law Courts facing three charges related to alleged cyber harassment after he was accused of publishing defamatory statements targeting Kisumu Senator Professor Tom Ojienda on Facebook.
The accused, identified as John Vianney Onyango, also known online as “Jay Vee Ke”, is alleged to have shared a series of posts and videos on his social media account containing claims about relief food distribution linked to Prof. Ojienda’s office.
Court documents indicate that Onyango allegedly accused the senator’s office of mishandling relief supplies, including claims that residents had raised concerns over the quality of maize flour distributed to members of the public.
The prosecution told the court that one of the alleged posts was published on April 14, 2026, where Onyango shared a video with a caption claiming that an elderly woman had been left in tears due to alleged fraudulent activities connected to relief food programmes.
Accused Allegedly Posted Multiple Videos Online
In another charge, Onyango is accused of making a Facebook post on April 16, 2026, alleging that residents in Kisumu Central were experiencing hunger because of alleged interference in the distribution of relief food.

The State further claims that on April 29, 2026, the accused uploaded another video in which he alleged that residents had demanded investigations into claims involving contaminated maize flour distributed through Prof. Ojienda’s office and allegedly coordinated by a county official.
According to the prosecution, the accused either knew or should have known that the statements published online could damage the reputation of the senator.
The charges were brought under Section 27(1)(b), read together with Section 27(2), of the Computer Misuse and Cybercrimes Act, 2018, which addresses cyber harassment offences.
Ojienda Accuses Suspect of Repeated Online Attacks
While addressing the court, Senator Tom Ojienda claimed that the accused had repeatedly engaged in publishing similar content targeting him.

“That is what he does. We are not dealing with one post; he will be here many times,” Ojienda said.
The senator further alleged that Onyango was responsible for creating and sharing the posts himself, adding that the allegations contained in the Facebook publications were false and damaging.
The prosecution maintained that the case involved more than a single online publication, arguing that the alleged communications formed part of a pattern that affected the senator’s public image.
The accused denied the charges before the court and was released on a cash bail of Ksh 50,000 as the matter awaits further proceedings.
