Blow to Owalo as Tribunal Declares Gor Mahia Patron Role Unconstitutional

The Sports Disputes Tribunal (SDT) has declared the confirmation of Eliud Owalo as Gor Mahia Patron unconstitutional, nullifying the decision in a case filed by former Gor Mahia Secretary General Sam Ochola.

In its ruling, the Tribunal found that the process used to confirm Owalo as the club’s Patron did not follow the Gor Mahia Constitution.

“The confirmation of Hon. Eliud Owalo as Patron of Gor Mahia Football Club… was unconstitutional, ultra vires and undertaken by an organ lacking the constitutional mandate to do so,” the Tribunal ruled.

The Tribunal further declared that the confirmation was invalid from the beginning.

“The said confirmation is hereby declared null and void ab initio and of no legal effect whatsoever.”

Gor Mahia Patron Eliud Owalo Barred From Acting

The Tribunal ruled that Owalo cannot hold or perform the duties of the Patron unless he is appointed through the process outlined in the club’s Constitution.

“The Interested Party shall not hold or exercise the office of Patron unless and until lawfully appointed in accordance with the Club’s Constitution.”

The decision means Owalo cannot continue serving as Gor Mahia Patron until the club completes the required constitutional process.

Tribunal Orders Gor Mahia to Hold AGM

The Tribunal also directed Gor Mahia’s Executive Committee to convene an Annual General Meeting (AGM) within 60 days.

The purpose of the meeting will be to constitute the club’s Board of Trustees in line with the Gor Mahia Constitution.

According to the ruling, the Board of Trustees must first be established before the club can appoint a Patron.

Patron Must Be Appointed Through Proper Process

The Tribunal emphasized that the appointment of the Gor Mahia Patron must strictly follow Article 5.4 of the club’s Constitution.

It stated that only the Board of Trustees has the constitutional mandate to appoint the Patron after it has been properly constituted.

The Tribunal added that no other organ of the club has the authority to make that appointment.

The ruling follows a petition filed by former Gor Mahia Secretary General Sam Ochola, who challenged the legality of Owalo’s confirmation as the club’s Patron.
