KRA Clarifies Cargo Clearance Rules Amid Stakeholder Concerns

The Kenya Revenue Authority (KRA) has responded to concerns raised by clearing agents, motor vehicle dealers and other stakeholders over cargo clearance processes.

In a press statement issued on Monday, September 7, 2026, the authority said some of the requirements being questioned are anchored in law.

KRA said the requirement for an export declaration when clearing imported goods is provided for under Section 23B of the Tax Procedures Act.

The Authority said it is required to implement and administer laws passed by Parliament while also supporting legitimate trade and business activities.

“KRA is mandated to implement and administer legislation enacted by Parliament, while at the same time facilitating legitimate trade and business operations,” the Authority said.

The clarification comes after concerns from the Kenya International Freight and Warehousing Association (KIFWA), clearing agents, motor vehicle dealers and other industry stakeholders over cargo clearance procedures.

KRA Promises to Minimise Disruptions

KRA said it understands the concerns raised by affected stakeholders and will work with them to ensure that statutory requirements do not create unnecessary disruptions to legitimate businesses.

The Authority said it remains committed to balancing compliance with the need to facilitate trade.

“KRA is committed to working closely with affected stakeholders to ensure that the implementation of statutory requirements promotes compliance while minimising unnecessary disruption to legitimate business activities,” it said.

Authority Keeps Off Motor Vehicle Valuation Case

On concerns surrounding motor vehicle valuation, KRA said it could not comment on the specific valuation methodology because the matter is currently before the court.

The Authority cited the principle of sub judice, which prevents parties from commenting on matters that are actively before the courts in a way that could interfere with the judicial process.

“KRA therefore refrains from commenting on the specific merits of the valuation methodology in accordance with the principle of sub judice, pending the direction and determination of the court,” the Authority said.

Authority Pledges Continued Engagement

KRA said it will continue engaging freight forwarders, clearing agents, motor vehicle dealers and other stakeholders to address challenges affecting cargo clearance.

The Authority said consultations will focus on finding practical solutions that remain within the law.

“Through ongoing consultation and dialogue, KRA will continue to explore practical and lawful solutions to operational challenges affecting cargo clearance and trade,” it said.
