Court Drama as Woman Accuses Brother-in-Law of Taking Over Her Home

Drama erupted at the Eldoret Law Courts when a man named Peter engaged in an argument with his sister-in-law over a dispute of their family land.
Nancy Kigen accused her brother-in-law of occupying her house after chasing her away with a machete.
Nancy, a nurse who is attached to Rift Valley Technical Training Institute (RVTTI), told the court that she and her husband, Daudi Kigen, had been forced out of their matrimonial home following disagreements over their family land.
She alleged that Peter had occupied the house and posed a threat to their safety.
Land Dispute
The court heard claims that the dispute revolves around land occupied by members of the extended family.
Nancy further alleged that the accused had interfered with property on the land, including cutting down trees despite existing court directions regarding the matter.

According to her testimony, she and her husband had previously assisted Peter by constructing a house for him and his family.
She expressed concern that Peter had since declined to leave the couple’s home, despite having an alternative residence.
Accused Pleads Not Guilty
Peter, however, rejected the allegations. In his defence, he told the court that he was temporarily staying in his younger brother’s house with permission while completing his own home.
He maintained that he had not unlawfully taken over the property.
The accused also argued that the land in question remains registered under their father’s name and that none of the brothers individually owns the parcels they currently occupy.
The dispute emerged during the hearing of a separate criminal case in which Peter is accused of maliciously damaging a motorcycle valued at Ksh104,000.
Accused Faces Other Charges
The prosecution alleges that the offence occurred on June 5 2025, in Kiptimet village, Ainabkoi Sub-county, Uasin Gishu County.
Peter has denied the charges against him.
In her ruling, Principal Magistrate Beatrice Toroitich cautioned the accused against interfering with the disputed property or intimidating the complainant.

She warned that failure to comply with court orders could lead to the cancellation of his bond terms.
The prosecution is expected to call five witnesses in the case. The matter will be mentioned again on September 8 2026.
