Earthbanc Wins Big as High Court Dismisses GPI Lawsuit

The High Court of Eldoret has thrown out legal claims brought by Green Planet Initiative (GPI) 2050 Foundation in 2025 against Earthbanc AB, a clear legal victory for the Swedish technology company and its Kenyan subsidiary, Earthtree Company Limited.

The lawsuit revolved around the disagreements between the plaintiff and Earthbanc, which was the main contractor of the Regeneration Kenya Project.

In its ruling passed on April 30, 2026, the High Court declined all the claims, citing lack of legal substance in the suit.

This was one of the cases that drew much interest for being a conflict of interest within the fast-growing climate and sustainability sector in Kenya.

“Earthbanc AB wins battle against Kenyan contractor Green Planet Initiative 2050 Foundation,” the press release read.

The High Court handed down a complete win for Earthbanc AB and Earthtree Company Limited, declining all claims from the plaintiff and ruling that GPI pays for all legal expenses that the defendant incurred.

Court Disapproves of the Plaintiff’s Case and Behavior

In its ruling, the court was very clear about its opinion on the merit of the plaintiff’s case. It referred to it as a case devoid of “merit, legal foundation and substance on the face of it”, which indicated that the claims were unfounded.

Moreover, the court was dissatisfied with the behavior of GPI in connection with the implementation of the contract with Earthbanc.

The court pointed out that the party that did not fulfill its contractual obligations could not be expected to compel the fulfillment from the other side as “a party who fails to perform his or her side of the bargain cannot enforce the contract against the other party.”

The cause of the legal battle can be traced back to GPI’s involvement in the Regeneration Kenya Project.

In particular, GPI had been hired by Earthbanc for the implementation of the project, although the contract between GPI and Earthbanc ended in April 2025.

Termination of Contract and Financial Disputes

Court documents showed that GPI had admitted that there were no outstanding balances owed by Earthbanc AB.

Such an admission would put the plaintiff at a further disadvantage because financial disputes are always a major factor in such contract lawsuits.

“The plaintiff confirmed that there are no amounts due or owing from Earthbanc AB,” court documents stated.

This admission supported the defendants’ claim that they had either completed all the terms and conditions of the agreement or nullified them after terminating the contract.

Earthbanc AB said it was happy with the decision and that it will now proceed with its key mandate of restoring degraded lands and using nature-based solutions in several jurisdictions.
