Mother Sues School After Grade 8 Daughter Was Suspended For Staying With Male Learner in Airbnb

A mother has sued Hospital Hill Comprehensive School, its head teacher, the chairperson of the Board of Management and the Teachers Service Commission (TSC) after her Grade 8 daughter’s suspension over claims that she booked an Airbnb with a male learner during the mid-term break.

The case, filed at the Milimani High Court, accuses the school of violating the girl’s privacy, making false allegations and denying her a fair hearing before suspending her.

According to court documents, the school sent the learner home on July 3 and directed her parents to take her for counselling at a government-owned institution before she could return to school.

The suspension letter reportedly stated that the girl had booked an Airbnb during the mid-term break and had been seen with a male learner, prompting the school to recommend counselling.

The school also required the girl’s mother to accompany her back to school on July 20.

Mother Denies Airbnb Claims Behind Daughter’s Suspension

The mother has dismissed the allegations as false, saying her daughter never rented, visited or stepped into an Airbnb during the school break.

“At no point whatsoever did the minor rent, visit or set foot in any Airbnb premises, nor did she pair up with a male learner as was alleged by the respondents in the suspension letter dated July 3, 2026. The said allegations are wholly inconsistent with the true facts,” the mother states in her court affidavit.

She says her daughter had informed her that she would attend a birthday party at a friend’s home where learners from different schools were expected.

The mother also told the court that she knew her daughter’s whereabouts throughout the break and ensured she travelled safely using an Uber.

“Following the said conversation, I continued monitoring the minor’s movements and ensured that she travelled safely from the school to Ngara by means of an Uber transport service,” she states.

She added that Uber ride records would support her account.

School Accused of Invading Girl’s Privacy

The mother also accuses a teacher of unlawfully accessing her daughter’s Instagram account during the school’s investigation.

According to the court documents, the teacher allegedly forced the learner to log into her Instagram account and inspected its contents without obtaining consent from her parent or guardian.

The mother argues that the school’s actions violated her daughter’s right to privacy.

Claims of Unfair Disciplinary Process

The lawsuit further claims that neither the mother nor her daughter was given a chance to respond to the allegations before the suspension was issued.

She says the suspension letter only directed the learner to undergo counselling but failed to explain how long the counselling would last, who would conduct it or whether she, as the child’s legal guardian, would be involved in the process.

The mother has asked the Milimani High Court to intervene, arguing that the school acted unfairly and violated her daughter’s constitutional rights. The case is now awaiting determination before the court.
