TSC Responds to Claims That Teacher Employment Letters Are Issued at State House

In a statement, TSC CEO Evaleen Mitei said the Commission had noted claims made by National Assembly Speaker Moses Wetang’ula and dismissed them as misleading.
“The Teachers Service Commission (TSC) has taken note of the statement made by the Speaker of the National Assembly, Hon. Moses Wetang’ula, suggesting that the President issues employment letters to Members of Parliament for the recruitment of teachers.The Commission wishes to clarify that the statement is not true and is misleading,” Mitei said.
TSC Constitutional Mandate
Mitei emphasised that the Teachers Service Commission has the constitutional mandate to recruit and employ registered teachers, including issuing their employment letters.
The CEO quoted Article 237(2)(b) of the Constitution of Kenya, 2010, which gives TSC this specific and not State House.
“The recruitment and employment of registered teachers, including the issuance of employment letters, is a constitutional mandate of the Teachers Service Commission. Article 237(2)(b) of the Constitution of Kenya, 2010 provides that the Commission shall recruit and employ registered teachers,” she said.

Further, Mitei said Regulations 55 and 56 of the TSC Code of Regulations for Teachers, 2015 provide for the recruitment of teachers and the issuance of Offers of Employment by the Commission.
Ruto Has No Mandate to Issue Teacher Employment Letters
Mitei said the Commission remains committed to transparency, fairness and integrity in the recruitment and employment of teachers.
The CEO dismissed the reports, stating that the TSC issues employment letters in accordance with the Constitution and other legal guidelines.

She clarified that President Ruto does not have the power to issue teacher employment letters, and the same applies to MPs and other political leaders.
“Accordingly, all TSC employment letters are issued by the Teachers Service Commission in accordance with the law and applicable recruitment guidelines. Neither the President nor Members of Parliament have the mandate to issue TSC employment letters,” she said.
