A man has been convicted and sentenced to 20 years in prison for robbery with violence after being positively identified by multiple witnesses as one of the attackers who violently robbed a resident.

Michael Onyango Ochieng, popularly known as “Jonyo,” was found guilty of assaulting and robbing John Okaka on May 11, 2024, within the Manyatta area of Kisumu.

The court heard that Okaka was attacked at around 7:00 a.m. by three men armed with a crowbar, who struck him on the head and made away with two mobile phones and cash.

Prosecution witnesses, including neighbours, medical officers and investigation officers, testified and presented evidence in court that placed the accused person at the scene of the crime, with some positively identifying him by name as a known individual in the area.

The victim, who sustained head injuries, also identified Ochieng as one of his assailants.

Medical evidence presented in court confirmed that Okaka suffered a wound consistent with blunt force trauma.

An identification parade conducted by police further reinforced the case against Ochieng. Despite denying the charges and claiming he had been arrested at a kiosk unrelated to the crime, the court ruled that the prosecution, through Raymond Nyonges, had proven its case beyond a reasonable doubt.

Delivering the judgment, Winam Law Courts Principal Magistrate Dennis Ogal stated that the evidence left no doubt that Ochieng was among those who assaulted and robbed Okaka.

The court convicted him under Section 215 of the Criminal Procedure Code.
