Former Deputy President Rigathi Gachagua has moved to court over his impeachment, saying he has abandoned his bid to be reinstated as Deputy President.
His legal team told the High Court that he no longer seeks to return to office but maintains that the impeachment was unconstitutional and is now pursuing remedies, including compensation and the nullification of the decision.
“I state to this Honorable Court on record, on behalf of His Excellency Rigathi Gachagua, that he is abandoning his prayer for reinstatement as Deputy President of the Republic of Kenya.” Gachagua’s lawyer said.
The amended petition presented in the High Court now shifts the focus entirely to the constitutional aspect of the impeachment rather than his reinstatement to office.
Gachagua is also seeking compensation for what he terms as an unlawful removal from office.

His legal team told the court that the new application seeks declarations that the impeachment process violated constitutional provisions and due process requirements.
Gachagua is also seeking financial compensation, including remuneration and damages arising from the remainder of his term, arguing that the process leading to his impeachment was procedurally flawed.
The case comes amid a series of legal battles rising from his October 2024 impeachment.
The Senate upheld his removal from office, marking the first time a Deputy President in Kenya was impeached.
Courts had previously declined to overturn actions that came after the impeachment, including the swearing in of his successor, with judges noting that some issues had been overtaken by events.

Legal analysts say the latest move signals a strategic shift by Gachagua aimed at securing damages and a constitutional interpretation of the impeachment process, rather than being returned to office.
The matter is currently before a multi judge bench, with the court is expected to give further directions on the hearing of the amended petition.
