Court Blocks FKF from Removing Abdullahi Yusuf

The High Court has ordered that the Football Kenya Federation (FKF) National Executive Committee (NEC) should not suspend or expel Abdullahi Yusuf from its membership until the constitutional petition case is heard.

This ruling was made by Justice Bahati Mwamuye on April 28, 2026, at a time when there were growing disputes regarding the management of the Federation.

In the ruling, the court barred the FKF NEC from taking any adverse action against Yusuf, reinforcing his continued stay in office until the matter is heard and determined.

“Pending the inter partes hearing and determination of the Petitioner’s Notice of Motion Application, a conservatory order be and is hereby issued restraining the Respondent from suspending, removing, or in any other way interfering with the Petitioner’s office,” the court directed.

Justice Mwamuye further ordered that any steps already taken against Yusuf be immediately reversed, restoring the status quo that existed before the disputed resolutions.

“In the event that any such adverse action has already been taken, the same is hereby stayed and the status quo ante operating immediately before the said action or decision be restored,” the order reads.

The dispute arises from resolutions reportedly passed during an FKF NEC meeting held on April 24, 2026, where members allegedly directed Yusuf to step aside from his role.

Yusuf, through his counsel Danstan Omari, has opposed not only the legitimacy of the proceedings but the resolutions taken therein, claiming they were unlawful and unconstitutional.

Disputed Meeting and Alleged Due Process Violations

According to court filings, Yusuf maintains that he was neither informed of the meeting nor allowed to defend himself against allegations.

He contends that the process violated fundamental principles of fairness and due process.

“The Petitioner was condemned unheard and was not afforded any meaningful opportunity to be heard before the making and implementation of the impugned resolutions,” the petition states.

Yusuf further told the court that he was not provided with key documentation related to the meeting, including agenda details, notices, evidence, or official records of proceedings.

According to him, the lack of such procedural guidelines makes the resolutions illegitimate and violates his constitutional rights.

Further, the petition highlights problems associated with governance at FKF, with allegations that the resolutions violated account mandate guidelines and leadership arrangements linked to the presidency of the federation.

Constitutional Issues and Governance Challenges

The crux of the petition lies in complaints that the NEC of FKF breached several constitutional issues, such as the right to fair administration, the right to fair hearings, the right to dignity, equality, and the right to access to information.

Yusuf seeks declarations from the court that the resolutions made on April 24 breached constitutional requirements and ought to be declared invalid.

He contends that the decision was made “ultra vires, irrational and procedurally unfair,” making the issue not only an individual problem but a public one.

Since the FKF organization operates under government funding, the petition stresses the importance of following due process in the governance of sports in the country.

Subsequent Legal Steps

The court has ordered Yusuf to file against the respondents and the Interested Party, the Cabinet Secretary for Sports, by April 29, 2026.

FKF and the respective ministry are required to file their respective replies by May 8, 2026, while the rejoinder should be filed by May 15, 2026.

The case is set to be mentioned on May 19, 2026, where the court will check whether the orders were followed and give directions on the fast track hearing of the case.
