Father & Son Jailed for Assaulting Woman Over False Genital Disappearance Claim

A Kilifi court has sentenced a father and his son to one year in prison after being charged with assaulting a woman on false claims that she made the son’s genitals disappear.

Benson Ngala, 49, and his 19-year-old son, Ruphus Chai, pleaded guilty to assault causing actual bodily harm, contrary to Section 251 of the Penal Code.

Principal magistrate Ivy Wasike heard in court that the two jointly and unlawfully assaulted Asha Samini, causing her injuries to her body.

The incident took place on July 5, 2026, at around 5.00 p.m. in Mdangarani village, Kauma sub-county, Kilifi county, as reported to the court.

How The Incident Took Place

According to the prosecution, Ruphus was walking home from his farm when he met Asha Samini.

After the two exchanged greetings, Asha asked him whether he was well.

Ruphus later claimed that he experienced a cold sensation in his body and alleged that Asha, who was dressed in a Muslim robe, had caused his genitals to disappear.

He immediately called his father, Benson, who rushed to the scene before the two ganged up against Asha.

They confronted Asha and assaulted her while at the same time accusing her of being responsible for the son’s disappeared genitals.

A crowd was attracted to the incident, which then joined in the assault on Asha.

Kilifi Police Involvement

She was eventually rescued by members of the public who took her together with the two accused persons to Jaribuni Police Post.

The police then escorted Ruphus to Jaribuni dispensary, where his genitals were checked, and a medical examination proved that they were intact and working normally.

Meanwhile, Asha was referred to Kilifi county hospital for treatment and was also issued with a P3 form the following day to document her injuries that she sustained.

During mitigation, Benson told the court that his wife was unwell and his children depended on him financially as he is the breadwinner.

Ruphus, who is a Grade 9 student at Mrarani, pleaded to be allowed to continue with his education.

Sentencing

Principal Prosecution Counsel Nancy Njeru opposed a lenient sentence and urged the court to impose a stiff punishment, arguing that the accused had put lives at risk.

She told the court that the assault placed Asha’s life in danger and noted that cases of mob justice linked to witchcraft have become increasingly common in the Coast region, often resulting in injuries and loss of life.

The prosecution further stated that the complainant, the sole breadwinner of her family, continues to suffer serious injuries, including a fractured hand and urinary tract complications.

In delivering the sentence, Magistrate Wasike said the accused had fabricated a false narrative that endangered lives.

The court further directed that the complainant will continue receiving treatment at Kilifi County Hospital and that the Department of Gender provide her with psychosocial support.

The two accused, father and son, were granted 14 days to appeal against both the conviction and the sentence as it is their constitutional right.
