HON. ADEN BARE DUALE

Cabinet Secretary Aden Duale’s directive ordering the scrapping of the Bachelor of Science in Oral Health programme at Mount Kenya University has been quashed by the High Court.

Authorities stated the Ministry of Health was found to have acted beyond its powers.

The court ruled that the programme “is legally accredited by the Commission for University Education” and that “the Ministry of Health has no legal authority to shut down university academic programmes,” said MKU in a statement shared on X.

Court Ruling on Mount Kenya University’s Oral Health Programme

The ruling means training for more than 225 students whose studies had been halted will resume.

In its ruling, the court found that the ministry had violated the Universities Act.

“The court found that the Ministry acted outside its mandate,” MKU said, also affirming that the only institution with the power to approve and close a university course is the Commission for University Education.

MKU termed the ruling ” A MAJOR WIN FOR MOUNT KENYA UNIVERSITY’S ORAL HEALTH PROGRAMME”.

“The programme remains valid and protected as students will be allowed to continue their studies,” the institution confirmed.
