Dr Rose Mbithe, Two Children Slapped with Second Murder Charges as DPP Approves Charges in Kyalo Mbobu Case

The Director of Public Prosecutions (DPP) has approved murder charges against five suspects over the killing of lawyer Kyalo Mbobu, with Dr Rose Mbithe Mulwa and her two children now facing a second murder case.
Announcing the decision on Thursday, October 8, 2026, the DPP also named police constables Julius Kipkoech Cheruiyot and Kennedy Kipkemei Borboroi among those facing the charges.
“The Director of Public Prosecutions (DPP) has approved murder charges against five suspects accused of killing lawyer Mathew Kyalo Mbobu,” DPP stated.
In its statement, the prosecution listed the individuals who will face the charges before the High Court.
“The suspects are politician Rose Mbithe Mulwa, her two children, Chris Mulwa and Angela Mulwa, and two police constables, Julius Kipkoech Cheruiyot and Kennedy Kipkemei Borboroi,” DPP stated.
Kyalo Mbobu Case Linked to Dr Victoria Mutiso Murder Probe
Meanwhile, the new charges come as investigators examine possible links between the killing of Kyalo Mbobu and the separate murder of Dr Victoria Mutiso.
Mbithe and her two children had previously faced murder charges over Dr Mutiso’s death, making the latest case their second murder case.

Five Suspects to Take Plea on October 27
On Thursday, October 8, Cheruiyot and Borboroi appeared before Justice Diana Kavedza at the High Court in Kibera but did not take a plea.
Instead, the judge directed them to undergo mental assessments at Mbagathi Hospital.
At the same time, Justice Kavedza ordered authorities to produce Mbithe and Angela Mulwa, who are remanded at Lang’ata Women’s Prison, together with Chris Mulwa, who is being held at Nairobi Remand and Allocation Prison.
Once the court receives the assessment report, the suspects will proceed with the plea-taking process.
“The five suspects are scheduled to take plea on 27th October 2026, after the court receives the mental assessment report,” DPP stated.

Kyalo Mbobu, a renowned lawyer, university lecturer and author, was killed along Magadi Road on September 9, 2025.
Following the shooting, detectives launched investigations that later led to the arrest of Cheruiyot in connection with the case.
