Gachagua Ally Hit With Ksh1.5 Million Fine, Ordered to Pay Within 72 Hours

The Independent Electoral and Boundaries Commission (IEBC) has fined Kipipiri MP Wanjiku Muhia Ksh 1.5 million after finding that she breached the Electoral Code of Conduct through inflammatory remarks allegedly made during a recent political rally in Nyandarua County.
The decision was made by the IEBC’s Electoral Code of Conduct Enforcement Committee after hearing a complaint against the legislator.
According to the committee, the evidence presented was sufficient to prove that Muhia violated Paragraph 6A of the Electoral Code of Conduct.
“The committee has established that the respondent has violated paragraph 6A. The complaint has been proved on the balance of probabilities, being the standard applicable to these quasi-judicial proceedings,” the committee ruled.
As a result, the committee imposed a Ksh 1.5 million fine on the Kipipiri MP.
IEBC Ordered MP to Issue Public Apology
Speaking on Friday, July 10, IEBC Commissioner Alutalala Mukhwana said the committee reached its decision after reviewing submissions from both parties, the applicable law, and the oral and documentary evidence presented during the proceedings.
Besides the Ksh 1.5 million fine, the committee ordered Muhia to issue a public apology over the remarks.
It also issued a formal warning directing the legislator to refrain from making similar statements in the future, saying her remarks had the potential to incite violence, intimidation, hatred, and hostility among Kenyans.
72 Hours to Pay Fine
The committee directed Muhia to pay the Ksh 1.5 million fine to the IEBC within 72 hours from the date the judgment was delivered.
It warned that failure to comply with the orders would attract further sanctions under the Elections Act, including the possibility of being barred from taking part in elections conducted by the commission.
“Failure to comply with the orders issued herein shall attract sanctions as provided for under the Elections Act, including issuing an order barring her from participating in any elections conducted by IEBC,” Commissioner Mukhwana said.

Remarks Triggered Investigation
The ruling stems from remarks Muhia allegedly made during a recent political rally in Nyandarua County, where she urged residents to organise themselves into groups of ten and monitor outsiders in their areas.
The remarks quickly went viral on social media and drew widespread criticism from Kenyans, including political leaders.
The backlash prompted the IEBC to summon the lawmaker to answer allegations that she had violated the Electoral Code of Conduct.
Before appearing before the electoral commission, Muhia had also been summoned by detectives from the Directorate of Criminal Investigations (DCI) in Ol Kalou to record a statement over the alleged incitement remarks.
Committee Summons Nakuru Town East MP David Gikaria
Meanwhile, Commissioner Mukhwana announced that the Electoral Code of Conduct Enforcement Committee had also summoned Nakuru Town East MP David Gikaria over alleged violations of the Electoral Code of Conduct during the ongoing Ol Kalou by-election campaigns.
According to the commissioner, Gikaria will appear before the committee to respond to allegations after he publicly admitted to distributing Ksh1.2 million to crowds during a political rally in Ol Kalou.
The MP reportedly said his team had been allocated the money to distribute across designated wards in the constituency.
“On Monday, this committee summoned David Gikaria, the MP for Nakuru Town East, to appear to respond to allegations of breach of the Code of Conduct in the ongoing Ol Kalou by-elections,” Commissioner Mukhwana said.
