Grandfather Sentenced to Life for Repeatedly Abusing Granddaughter in Narok

The Director of Public Prosecutions (DPP) has secured a life sentence against a 70-year-old man who has been convicted of committing incest with his granddaughter in Narok County.

According to the DPP, the judgement was delivered by Chief Magistrate Hezron Nyaberi of the Narok Law Courts, who found the accused guilty of incest contrary to Section 20(1) of the Sexual Offences Act.

The provision criminalizes sexual acts between relatives, with the law having severe penalties in instances where the victim is a child or minor.

According to the court, the accused committed the crime on multiple occasions at Talek trading centre in Narok West Sub-County.

Six Witnesses Presented

This is before the matter was reported to the authorities, which prompted investigations into the case, which eventually found the 70-year-old man guilty.

The accused repeatedly sexually abused the young school-going girl despite him being fully aware that she is his granddaughter.

Six witnesses were presented in court by the prosecution led by James Kigo and Leone Wandera, including the victim, a neighbour, a primary school teacher, a clinical officer and the investigating officer.

Medical evidence was presented, including the P3 form, treatment notes and the child’s birth certificate, which corroborated the victim’s testimony and linked the accused to the offence.

Evidence Provided

The prosecution argued that the documented evidence together with witness testimony supported the victim’s account and also established a relationship between the accused and the victim.

The court therefore found the victim’s story consistent and true and the accused’s defence was therefore dismissed as mere denial.

Magistrate Nyaberi also said that he found no credible evidence of malice or fabrication of the story; hence, the prosecution had managed to prove the case beyond reasonable doubt.

The accused was therefore sentenced to life imprisonment by Magistrate Hezron Nyaberi over multiple counts of sexual abuse and incest.
