High Court Orders IG Kanja, DCI Boss Amin to Personally Appear in Missing Persons Case

Inspector General of Police Douglas Kanja and Directorate of Criminal Investigations (DCI) Director Mohamed Amin on Monday, 20th July, personally appeared before the High Court in Nairobi after the court rejected the State’s application to exempt them from attending proceedings in a habeas corpus case involving the alleged disappearance of three men.

Justice Alexander Muteti had dismissed an application by the State to have junior police officers represent them or rely on affidavits only and ordered both senior security chiefs to appear in person.

The matter relates to the alleged abduction and disappearance of Macmilan Kiarie, Michael Oloo and Evans Otieno.

Family Testifies in Court about the Disappearance of a Missing Man

The hearing comes with a testimony from the family of one of the missing men.

Evans Otieno’s mother told the court that she had been looking for her son at police stations, hospitals and mortuaries for months without success.

Fighting back tears, she said the family went to Thika Level 5 Hospital, where they were shown almost 50 unidentified bodies, but none was her son.

Later, they searched at Nairobi City Mortuary but still could not trace him.

“My son has never been arrested and has no criminal case pending before any court,” she told the judge, pleading with the court to help locate him.

The proceedings are based on a habeas corpus application for the authorities to produce the three men or account for their whereabouts.

Court Demands Personal Appearance of Inspector General and DCI Director in a Disappearance Case

It is in this context that the court insisted that the Inspector General and the DCI Director appear in person after the court rejected the State’s application to have them represented by junior officers.

The hearing is still ongoing as the court continues to receive evidence from witnesses and family members in a bid to ascertain the circumstances surrounding the alleged disappearance of the three men and whether further orders should be issued against the respondents.

Justice Muteti thanked Kanja and Amin for attending court and excused them from the rest of the day’s proceedings after confirming their attendance.

He ordered that they should be recalled only if there were matters raised at the hearing which needed a personal answer from them.
