Petition Filed to Stop Adan Mohamed’s Appointment as KRA Commissioner-General

A legal dispute has emerged at the High Court over the appointment of Adan Mohamed as Commissioner General of the Kenya Revenue Authority (KRA). The petitioner argues that the decision violates retirement rules for public officers.
In a petition filed by Benard Opere, the court was asked to halt the appointment. He argues that Mohamed does not meet the age requirement set for senior public service roles.
Opere maintained that Mohamed is above the mandatory retirement age of 60 years under Regulation 70 of the Public Service Commission Regulations, 2020. He says this disqualifies him from leading the tax authority.
He further relies on public records that place Mohamed’s birth in December 1963. Based on that, he estimates that Mohamed is about 62 years old. He argues that this makes him ineligible for the position.
Beyond the age issue, Opere argues that the appointment violates key constitutional values. He cites Articles 10, 73 and 232 of the Constitution. These provisions require integrity, accountability, transparency, and merit in public service.

Alleged Breach of Public Service Law
He also argues that the appointment contradicts the Public Service Commission Act. In addition, he says it undermines the rule of law. He claims the process ignores clear retirement requirements. He warns that this could weaken compliance with public service regulations.
Opere urges the court to act quickly. He says Mohamed could assume office and start making major administrative and financial decisions at KRA. If that happens, he argues, reversing those decisions could become difficult.

Orders Sought
On that basis, Opere seeks conservatory orders. He wants the court to stop Mohamed from being sworn in or performing any duties as Commissioner General until the case ends.
Mohamed’s appointment as KRA commissioner was announced on May 18, 2026 through a Gazette notice issued by National Treasury Cabinet Secretary John Mbadi.
