Businessman Sues to Stop Sale of Ksh70 Million Peponi Road Property After Saving It From Auction

Nairobi businessman Rajendra Ratilal Sanghani has approached the Environment and Land Court seeking an injunction to prevent the sale of a disputed piece of land valued at Ksh70 million along Peponi Road.

He claims the defendants attempted to abandon the deal after he intervened to prevent the property from being auctioned with his money.

Sanghani has sued the defendants after lawyers representing them on January 29, 2026 issued a notice seeking to end the deal.

According to a notice sent by lawyers acting for Karen Nkatha Rimita, the buyers agreed to return the deposit of Ksh 7 million should the parties enter into a mutual termination and discharge agreement.

However, Sanghani states that he has never entered into any such agreement.

Financial Aid and Property Transaction Dispute

In a witness statement presented in court, Sanghani asserts he gave the first defendant an extra Sh1 million towards the transaction.

“The defendants accepted my financial aid to escape the impending auction but failed to tender the completion documents under the agreement for sale.” Stated Sanghani.

“There were wrongful, inequitable and unconscionable repudiation of the transaction by the defendants, who were then compelled to abandon the sale as they have received from them relief by virtue of his intervening in his money for the purpose of preventing the auction but later claim the sale transaction lapsed.” He stated.

In a supporting affidavit, Sanghani claims he has materially altered his position by moving to protect the land from auction while alleviating the pressure imposed upon the defendants due to the bank charge on the land.

He maintains that the property has been preserved from auction by his intervention and at the same time, the defendants were saved from a monetary loss.

Property Dispute and Legal Action

Sanghani now wants an order to prevent the defendants from advertising, selling, transferring or otherwise disposing of the property until the hearing of this suit.

He claims the property will otherwise be transferred to a third party despite his having saved it from auction.

“I acted in good faith, and the court should therefore protect my interests.” Stated Sanghani.

The Environment and Land Court in Nairobi has yet to set a date for the hearing of the suit.
