Ruto, Saitoti, Obado: The High-Profile Cases That Shaped Kioko Kilukumi’s Career

Before Kioko Kilukumi became the lawyer at the centre of Okoth Obado’s defence, his name had already appeared in some of Kenya’s biggest court battles.

From representing William Ruto during the early ICC proceedings to joining his legal team at the Supreme Court in 2022, Kilukumi has spent decades navigating cases involving prominent political figures, major criminal allegations and constitutional questions.

The Senior Counsel is now back in the spotlight following his role in the Sharon Otieno murder case, where he represented former Migori Governor Okoth Obado alongside lawyer Rodger Sagana.

Early Life, Education and Family

Kioko Kilukumi was born and raised in Mwala, Machakos County, and attended Mwala Secondary School before joining the University of Nairobi.

He graduated with a Bachelor of Laws degree in 1990, marking the beginning of a legal career that would later take him into prosecution, private practice and some of Kenya’s most closely followed court cases.

After university, Kilukumi joined Kaplan & Stratton Advocates, where he worked between 1990 and 1993. He later spent three years as a public prosecutor in Swaziland, now Eswatini, before returning to Kenya in 1996 and establishing his own legal practice.

Away from court, Kilukumi is married to Pamela Kilukumi, a communications lecturer, and they have two sons.

His professional interests have remained closely linked to criminal litigation, although his practice has also covered constitutional matters, election disputes and other complex cases.

How Kilukumi Built His Legal Career

Kilukumi’s move into public prosecution in Eswatini gave him experience on the other side of criminal proceedings before he returned to private practice in Kenya.

His name later emerged in government circles when President Mwai Kibaki nominated him for the position of Director of Public Prosecutions in 2011. The nomination became part of a constitutional dispute over the appointment process, with the matter eventually ending in court and the nominations being withdrawn.

Kilukumi continued with private practice and became involved in cases touching on politics, criminal law and public institutions. His work included representing former Internal Security Minister George Saitoti and former Finance Minister David Mwiraria, among other prominent clients.

He was appointed chairperson of the Energy and Petroleum Tribunal in 2021 for a three-year term, adding a public regulatory role to his work as an advocate.

In 2020, President Uhuru Kenyatta conferred on Kilukumi the rank of Senior Counsel alongside other leading Kenyan advocates.

Ruto, the ICC and Other High-Profile Cases

One of Kilukumi’s most prominent assignments came when he joined William Ruto’s legal team at the International Criminal Court in The Hague.

In 2011 that Kilukumi was among Ruto’s lawyers as the ICC case over the 2007–2008 post-election violence moved forward.

His role in that defence team did not last throughout the proceedings. Ruto later restructured his legal representation and Kilukumi was dropped from the ICC team in 2013.

Years later, Kilukumi again represented Ruto, this time as part of the legal team defending his victory in the 2022 presidential election petition at the Supreme Court.

His courtroom work has also taken him into cases involving major financial scandals and former public officials. He represented clients in matters linked to Goldenberg and other high-profile investigations, while continuing to handle criminal and constitutional litigation.

Kilukumi’s Role in the Sharon Otieno Case

Kilukumi became part of the Sharon Otieno murder case as lead counsel for Obado, who was charged alongside his former personal assistant Michael Oyamo and former Migori County clerk Caspal Obiero over the 2018 killing.

The trial ran for several years and eventually heard evidence from 42 witnesses before the prosecution and defence completed their cases. Kilukumi and Sagana challenged the prosecution’s evidence while presenting Obado’s defence before the High Court.

During final submissions, Kilukumi argued that the prosecution had failed to produce evidence linking Obado to Sharon’s killing and urged the court to acquit his client.

The court convicted Obado, Oyamo and Obiero in July 2026, bringing the murder trial to the sentencing stage. Kilukumi’s role in the case adds another prominent criminal trial to a legal career that has included some of Kenya’s most closely followed cases.
