Former Kenyan New York Auditor Jailed for Up to 12 Years Over Ksh52 Million Theft

A 42-year-old Kenyan man, Tobias Otieno, has been sentenced to between four and 12 years in a New York state prison after admitting to stealing $405,843.25 (approximately Ksh 52 million) from the Town of Wallkill while working as a state auditor.
Otieno, who previously used the name Tobias Ochieng, was sentenced on August 18, 2026, in Orange County Court after pleading guilty to Grand Larceny in the Second Degree as a Public Corruption Crime, a Class B felony.
According to the Orange County District Attorney’s Office, Otieno was employed as an Auditor 1 with the New York State Office of the State Comptroller and was assigned to audit the Town of Wallkill’s finances between June 23, 2022, and September 1, 2024.
His responsibilities included examining the municipality’s financial operations, payroll, procurement and non-payroll disbursements. During the audit, he was given access to Wallkill’s bank accounts and financial records.
Money Stolen
Prosecutors said Otieno used that access to transfer municipal funds into personal business accounts that he controlled. The money amounted to approximately $405,843.25.
The case was investigated by the Orange County Sheriff’s Office and the Orange County District Attorney’s Office through the county’s White Collar Crimes Task Force, with assistance from forensic auditors from the New York State Comptroller’s Office.

Investigators examined bank and business records to trace the source and movement of the money.
A search warrant was also executed at Otieno’s Hyde Park residence on July 10, 2025.
Otieno Was Fired
These allegations emerged in late 2024, after which the Comptroller’s Office suspended Otieno and later terminated his employment.
A subsequent review of his previous audit work did not find evidence that he stole from other municipalities.
Otieno had joined the New York State Comptroller’s Office in 2018 as a municipal auditor.
His earlier assignments included audits involving several school districts and municipalities in New York.
The Town of Wallkill reported the suspected fraud to its financial institution after the irregularities were discovered.
Funds Returned
Additionally, the bank subsequently reimbursed the municipality for the stolen funds.
Authorities also said their investigation found no evidence of wrongdoing by Wallkill town officials or employees.
Otieno pleaded guilty on February 17, 2026, admitting that he used his position and access to the town’s financial accounts to transfer the funds into his personal business accounts.
Under the plea agreement, prosecutors sought a sentence of four to 12 years in prison.
His stolen proceeds were subsequently recovered, and the court did not order further restitution as part of the sentence.
Reports on the case have also indicated that Otieno’s defence cited more than $200,000 in personal debt, reportedly linked in large part to fertility treatment expenses.
Court Ruling
However, the financial difficulties did not alter the criminal proceedings or the sentence imposed after his guilty plea.
Orange County District Attorney David Hoovler described the case as a breach of the trust placed in Otieno through his government position.

On the other hand, New York State Comptroller Thomas DiNapoli said the sentence reflected the consequences of betraying the responsibilities entrusted to him.
Otieno will now serve a minimum of four years and could remain in prison for up to 12 years under the sentence imposed by the court.
