Ex-MP Arrested in Ksh 56M Land Scam That Duped Dozens of Buyers

Detectives from the DCI Headquarters’ Land Fraud Investigations Unit (LFIU) have arrested former Member of Parliament (MP) Josephat Mwirabua, also known as Kabeabea, over a multi-million shilling land fraud scheme that allegedly defrauded investors of more than Ksh 56 million.
According to investigators, the case dates back to 2016 when a complainant, alongside several other investors, purchased plots measuring 50 by 100 feet from Diamond Property Merchants (DPM) Ltd.
Each buyer entered into individual agreements with the company and made payments directly into its bank accounts.
“In total, these innocent purchasers deposited approximately Ksh 16,476,950 into accounts belonging to the suspect,” the DCI said.
MP Victims Discover Land was Irregularly Transferred
However, the investors later discovered that the land in Kajiado had already been transferred to other individuals without their knowledge.
As a result, concern quickly spread among the buyers over the legitimacy of the transactions.
“They soon discovered that the parcel of land in Kajiado where their plots were supposedly located had been transferred to other individuals without their knowledge, and subdivision was conducted without their consent,” the DCI reported.
Consequently, the victims reported the matter, prompting investigators from the LFIU to launch a probe.
Upon completing the investigation, detectives forwarded the findings to the Director of Public Prosecutions (DPP), who approved charges against the suspect for Obtaining Money by False Pretences.

Josephat Mwirabua Linked to Second Greenhouse Land Scheme
In a separate case, more complainants accused Josephat Mwirabua, in his capacity as a director of Diamond Property Merchants Company Ltd, of advertising land parcels in Kajiado that were to be equipped with greenhouses.
“The complainants paid various amounts totalling Ksh 40,140,000. Unfortunately, the promised title deeds were never transferred, nor were the greenhouses installed,” DCI noted.

Arrest and Court Proceedings
However, when authorities summoned him to appear in court, Josephat failed to comply.
As a result, the Chief Magistrate’s Court in Kajiado issued a warrant for his arrest.
Acting on the warrant, detectives tracked him down and arrested him.
He is currently in custody, undergoing processing, and will appear before the Milimani Law Courts before officers escort him to Kajiado Law Courts, where the warrant remains in force.
Overall, authorities said that the case underscores the need for vigilance in land transactions and urge Kenyans to exercise caution when investing in property.
